Introduction

Unscheduled follow up inspection to the routine conducted on March 21, 2018.
Written response received by CCFL on April 9th as requested.

Contraventions
Previous Inspection - Contraventions observed on FIR #DCAR-AX3NXG have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11030 - CCLR s.13(3) - A licensee must ensure that, while children are under the supervision of employees, no one smokes or uses tobacco, holds lighted tobacco, uses an e-cigarette or holds an activated e-cigarette on the premises of a community care facility or in any vehicle used by employees to transport children.
Observation: At Licensing arrival an adult was observed smoking on the premises ( front porch of the home ) A detailed discussion occurred at the time of the routine to which the licensee included a plan would be put in place. This plan states that there will be no smoking on the premises during day-care hours.
Corrective Action(s): forward your plan to include how you will monitor your previous plan to ensure that smoking does not occur during day-care hours. Please include your hours of operation as part of the written plan.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: It is noted that many stored items have been cleared from the bathroom area since the routine inspection however the shower stall continues to be used to stored supplies and equipment among this was plastic bags accessible and described as a suffocation risk to young children. In addition items previously identified to be hazardous on the deck continue to be accessible as the installed gate is not secure( does not latch) A BBQ is located within the children's outdoor playarea and is on unlevel ground making it unstable - easily rocks and may cause injury should it fall on a child.
Corrective Action(s): please ensure children do not have access to items which may pose risk of injury or harm. Written response includes that the gate leading to the deck has been repaired , please ensure the gate is secured to prevent children from accessing the area should hazards be located within.

STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: CRC results are required for 2 family members , licensee included mailing the forms in April. CCFL provided an email outlining the CRC renewal and application process both manually and on-line.
Corrective Action(s): please ensure CRC results are held by all those living within the home over the age of 12 years. Please provide your plan to ensure individuals without clearance would not have independent access to children..

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Licensee posted a schedule of practiced fire drills , it was observed that a fire drill for the month of June had not occurred.
Corrective Action(s): please ensure a system is developed to capture each month in order to ensure monthly drills occur.
