Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: Licensing observed, in the Multi-Age playground area, an outdoor vent on the side of the building that had been pulled up at one side, causing the vent corner to protrude out which is a safety concern for children playing in that area.
Corrective Action(s): Please ensure the outdoor area is safe for all children.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: On review of staff files of which were present today at inspection, Licensing observed that 1 staff was missing character references. Licensee stated that she was waiting for a copy.
Corrective Action(s): Please ensure all staff are fully screened and documentatin obtained PRIOR to staff working at the facility

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: On review of staff files of staff present during inspection today, Licensing observed that 1 staff was missing immunization status. Licensee stated that she was waiting for a copy.
Corrective Action(s): Please ensure that all staff documention is obtained PRIOR to staff working at the facility as per the screening process

STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation (CORRECTED DURING INSPECTION): Licensing observed that one individual over 12 years of age was present in the Multi-age program as a volunteer without being screened. There was no Criminal record check (CRC) on site or any other documents in relation to a volunteer staff. Licensee asked the person to leave and obtain the CRC prior to returning.
Corrective Action(s): Please ensure that ALL documentation in relation to a volunteer person is obtained prior to them being present at the facility

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): Licensing observed that the Multi-Age attendance lists were not accurate. Children were being signed in by parents on the wrong sheet and there was only 1 sheet for the 2 programs. Licensee changed this by adding a 2nd sheet, 1 for each room.
Corrective Action(s): Please ensure that attendance records are accurate, particularly important in an emergency situation. It is the Licensee's responsibility to ensure accuracy at all times.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was The Licensee with 1 staff in the Summer preschool program and 11 children. There were 2 practicum students on site.
In the 2 Multi-Age programs there was 1 staff in each with a total of 9 children.
Staff to child ratio was in compliance with regulations
Staff exemptions is currently in place in the Multi-Age program
Care plans are complete and up to date.
Programming is posted and available for parent review and children's artwork is displayed. The program rooms are clean and inviting with a variety of equipment and resources available to the children.
Licensing observed Staff engaged with children using appropriate guidance techniques and language with a gentle tone.
Licensing observed the children in free play activities, snack time and outdoor play. The children were free to choose activities.

Discussions with the Licensee/Staff:-
- Licensing reviewed the requirement for attendance record keeping with the Licensee
- Licensing provided information regarding the Director of Licensing Standards of Practice for Active Play and discussed the requirements of the Active Play and Screen Time policies to be available to staff and parents by September 2017. These have been created and are in place in the facility handbook available to parents. Screen time policy needs to be added.
- Licensing recommends an audit of emergency consent cards in the Multi-Age programs to ensure accuracy in placement.
- Licensing recommends having a cover for the sandbox (which at present is empty due to glass being found in the sand) to prevent any contaminants getting in. Licensee is organizing this to be able to add sand at the weekend.
- Licensing reminded Licensee of the requirement to validate staff qualifications as well as post all staff certificates, even staff covering for an absent staff.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
