Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Contraventions
Previous Inspection - Contraventions observed on FIR #SWAR-A7WNT5 have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11060 - CCLR s.14(2) - A licensee must have one toilet and wash basin for every 10 children or fewer.
Observation: Licensing observed that the 1st bathroom in room 1 is inaccessible to children and used for storage. Licensee stated that she thought the exemption that is in place for room 2 to use the 2nd bathroom meant that it was shared between all children attending on a daily basis. Licensing clarified that the exemption refers to the 2nd bathroom in room 1 being used by the attendees of room 2 only. Bathroom 1 must be used by room 1 only.
Corrective Action(s): Please ensure bathroom 1 is accessible to the children attending the program in room 1.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: On arrival it was observed that both multi-age groups were utilizing the same space - a total of 9 children were present in room 1. The groups were observed to quickly split into 2 groups straight away. Licensee stated that they were having a diaper emergency and that they generally split as all the children arrive at the same time around 9am. Licensing observed the staff from room 2 and 1 of the children in room 2 close to the entrance of room 1, indicating that they were present in the space.
* Licensing also observed through children's files and attendance records that room 1 had more 4 children under 3 years - the requirement being only 3 children under 3 years allowed in one group size.
Corrective Action(s): Please ensure that the groups remain separated at all times. Licensing requires a barrier to be input to make a definite separation (by Dec 2nd) of the 2 groups when Room 2 is using the bathroom.
* Please ensure that children are separated into the correct group sizes as per Schedule E

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: On arrival, Licensing observed that the food eating area still contained food items and lunch kits which had not been cleared from morning snack time. Licensing also observed a child randomly take a half eaten muffin from a high chair and walk away eating it without handwashing. Licensee stated that she just hadn't got around to clearing the tables.
Corrective Action(s): Please ensure that a good hygiene program is in place to remove uneaten food products after each meal time, particularly foods that require refridgeration. Tables must be washed and sanitized after food use and before other activities and again, prior to eating another meal.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing reviewed attendance records and there are occasions when children are not signed out of the program. This is a repeat contravention.
Corrective Action(s): Please ensure that accurate attendance records are kept and clearly identify when children move from one room to the other

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was the Licensee and 1 other staff with a total of 9 children in 2 programs.
Staff to child ratio was in compliance with regulations but on arrival, both groups were in Room 1. Licensing has recommended a safety gate/barrier be put in place between the doorway of bathroom 2 and Room 1 to ensure that the groups do not mix during a transition time.
Exemption is in place for Room 2 to use the 2nd bathroom in Room 1. (see above for violation) This exemption will be added to the license for future clarity once Licensee resubmits an exemption to request the use of 1 bathroom for both groups - total of 12 children.
Programming is posted and available for parent review.
Licensing observed Staff engaged with children during their play. Licensing observed a lack of role modelling during meal times and general play.
Licensing observed the children running around the facility on arrival. Noise levels were high and the materials and equipment were covering the floor, causing concern for safety. Children had access to free play materials and were observed to be climbing on tables and shelving.

Discussions with the Licensee:-
- Licensing reviewed the exemption approval with the Licensee and requests action as per the contravention cited above.
- Licensing provided information and resources regarding 'Live 5210' and the recent change in licensing regulations. Discussed the requirements for ECE certificate verification as well as the new Director of Licensing Standards of Practice which requires an outdoor policy and screen policy to be adapted prior to September 2017. Further information will be provided by licensing.
- Licensing recommends re-evaluating the program to provide more organized activities to help reduce the 'chaos' of play at varying times.
* Licensing also recommends clearing the clutter from the top of a shelving unit in the kitchen area - as children don't have access to this area, safety of falling items onto a child's head are not of a major concern but are a concern of falling during an earthquake.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection will be conducted due to the number and nature of the contraventions.
