Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Staff's certificates were not posted onsite.
Corrective Action(s): Please ensure that all staff certificates are posted in a prominent place within the facility.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Criminal Record Check on file is not site specific.
Corrective Action(s): Please ensure that all staff's files are complete.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A minimum of two character references were not obtained for one or more employees.
Corrective Action(s): Please ensure all staff's files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one or more employees.
Corrective Action(s): Please ensure that all staff's files are complete.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: Valid first aid certificate for staff on site was not available.
Corrective Action(s): Ensure that children have an immediate access to staff with valid first aid and CPR certificate at all times.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Earthquake drills for 2020 and 2021 were not recorded. Manager said that emergency drills were practiced with the children.
Corrective Action(s): Ensure that current records of emergency drills are kept.

Comments

On the inspection date of February 14, 2022, there were 2 children and the manager present. The Licensee was onsite and assisted LO with today's inspection. At this inspection, above noted contraventions were identified. The Licensee is required to address the contraventions noted to bring the facility into compliance and submit your written response to Licensing by below date.
This report was reviewed and discussed with the manager and the Licensee onsite. As part of this Routine Inspection a Facility Risk Assessment Tool was completed. This inspection and the risk assessment were emailed to the facility on Feb 15, 2022.
LO provided the following education/ had discussion with the Manager:
- Response to Covid-19: In event the facility is closed due to staff shortage, i.e. unable to maintain staff:child ratio, submit a Reportable Incident to Licensing
- Fire extinguisher to be serviced annually
