Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The manager's name was not posted within the facility.
Corrective Action(s): Ensure that the name of the manager is posted in a prominent place within the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): IT class: a bottle of bleach was stored on top of the shelf in the washroom (above diaper changing area).
Corrective Action(s): Ensure that a healthy and safe environment is provided at all times while children are in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: LO observed and discussed the following with the Manager:
- Both classrooms walls: many areas of paint chips, holes, exposing drywall to the children.
- 2 plates around the plugs were broken
Corrective Action(s): Ensure that all furniture, equipment and fixtures are clean and in good repair while children are in care.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 5 staff files were reviewed; Criminal Record Check were not obtained for 2 staff members.
Corrective Action(s): Ensure that all staff files are complete.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Emergency Supplies are insufficient to implement the emergency plan. LO discussed about developing a system to ensure that emergency kit is adequately prepared.
Corrective Action(s): Ensure there are sufficient supplies for each child and staff, to respond and recover from any emergency.

Comments

At the inspection dated August 30, 2023 there were 24 children and 5 staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer for review. As part of this Routine Inspection a Facility Risk Assessment Tool is completed. This inspection report was reviewed with the Manager onsite and the copy was emailed to the facility.

The following were discussed with the Manager:
- Criminal Record Check
- Emergency Supplies
- Exemptions
- Outdoor equipment, i.e. walking rope
- Naproom supervision
- Child's photograph or digital image: to be updated
