Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Manager's name was not posted on site.
Corrective Action(s): Ensure that the name of the manager is posted in a prominent place within the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: LO observed many areas of the paint chips throughout the facility, exposing drywall to the children.
Baby gate in IT room is broken and children have access to the kitchen/washroom where they store cleaning supplies and diapering creams.
Corrective Action(s): Ensure that a healthy and safe environment is provided at all times.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Fire Extinguisher has not been serviced annually.
Corrective Action(s): Ensure that fire extinguisher is serviced and tagged annually.

HYGIENE AND COMMUNICABLE DISEASE: 15010 - CCLR s.14(4)(a) - A licensee, other than a licensee who provides a care program described as either Preschool (30 Months to School Age) or Group Child Care (School Age), must have in a community care facility a sturdy surface for changing diapers, located outside the food preparation area, next to (a) a covered container for soiled clothing.
Observation: LO observed that soiled diaper was placed in a bag under the washroom's sink. A covered container was not available to dispose soiled diaper.
Corrective Action(s): Ensure that a covered container ( garbage bin) is available within the washroom.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: 6 files were reviewed; 1 child's immunization status was not obtained.
Corrective Action(s): Ensure that all children files are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): There were 6 children onsite; only 5 of them were signed in.
Corrective Action(s): Ensure that accurate record of daily attendance is kept.

Comments

At the inspection dated August 30, 2023 there were 8 children and 2 staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer for review. As part of this Routine Inspection a Facility Risk Assessment Tool is completed. This inspection report was reviewed with the Manager onsite and the copy was emailed to the facility.

The following were discussed with the Manager:
- Storage for extra equipment and toys
- Napping equipment: this is not recommended safe sleeping equipment as per the Canadian safety regulation
- Food storage
- Reportable incident
- Naproom supervision
- Location of hand towels: should be inside of the washroom, readily accessible to the children
- Child's photograph or digital image: to be updated
