Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: During the inspection it was observed that two staff certificates were not posted.
Corrective Action(s): Please ensure staff certificates are posted in a prominant place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following inside the facility:
- Many shelves over 4 feet tall were not anchored to the wall. This was present in all of the rooms that were observed. This could present a potential falling hazard. In discussion with the Manager she stated that the facility had recently been repainted and thecontracter had forgotten to secure the shelves to the wall.
-In one of the rooms a loose shelf was noted in the sleep room. This could present a potential falling hazard as two children's's sleep mats were placed directly under the loose shelf.
-Several shelves contained heavy items on top of unsecured shelves such as: larger toys and a full piano keyboard. This could be a potential falling hazard. The piano keyboard was removed during the inspection.
-In one of the classrooms one bleach bottle was being used to disinfect diaper changing surfaces and the tables used for eating and playing. This could present the possibility of cross contamination. Please correct this by November 21, 2019
-Toilet brushes were accessible to the children

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following inside the facility:

-Several child sized chairs had ripped fabric
-A blind cord was unscrewed from the wall and the screw was exposed
-A water table had a broken lid (this was sharp to the touch)
-A shelf was damages and had several paint chips
-One wall had peeling paint in the room and the washroom

Corrective Action(s): Please ensure the facility and the equipment are in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11170 - CCLR s.16(3)(b) - A licensee must ensure that the entire outdoor play area is (b) constructed in a manner, and using materials, that are suitable for the age and development of the children intended to use it.
Observation: Licensing observed that the landscape fabric in one of the playgrounds was exposed. This could present a potential tripping hazard. This is a repeat contravention from inspection # KSEY-B8JRK61
Corrective Action(s): Please ensure the playground is constructed in a manner that is free from hazards.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following inside the facility:
-Many bleach bottles were within easy reach of the children. This could present a possible poisoning or blinding hazard
-A bottle of disinfectant spray was on the counter at the children's level. This could present a possible poisoning or blinding hazard
-Three bottles of chemicals were observed under the sink in two classrooms. This could present a possible poisoning hazard
-In all of the classrooms staff bags and purses were easily accessible to children. This could present many potential hazards.
-Rust was observed on the toilet fixtures in one washroom and a stepping stool. This could present a possible health hazard.
-A blender was observed under the sink in one of the classrooms. It was noted that the blender was in a plastic bag. This could present a possible cutting hazard
-Several electrical outlets were exposed. In one classroom this was corrected during the inspection.
-Several cords for a fan, light tables, and a stereo were not secured. This could present a potential strangulation hazard.

The following was observed in the outside play area:

-Rust on two knobs in the play area. This could present a possible health hazard
Corrective Action(s): Please ensure children do not have access to any objects or substances thatare hazardous to their health and safety

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Eight staff records of nineteen were reviewed. One staff's character references were not available to review. In discussion with the Manager she stated that the staff had recently transferred from another facility and she was waiting for the documentation. This is a repeat contravention from inspection # DCHG-AVCTZP

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Eight staff records of Nineteen were reviewed. One staff was missing a record of the person's work history. In discussion with the Manager she stated that the staff had recently transferred from another facility and she was waiting for the documentation.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Licensing reviewed the records for fire drills in each room. Several rooms were missing a record of implementing the fire drill on a monthy basis. This is a repeat contravention from inspection # KSEY-AKBRPG.
Corrective Action(s): Please ensure fire drills are completed and recorded on a monthly basis.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: During the inspection eight staff records of nineteen records were reviewed. One staff was missing a site specific criminal record check (CRC). This is a repeat contravention from inspection # KSEY-B8JRK61
Corrective Action(s): Please ensure staff CRC's are site specific

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: During the inspection no record of the emergency evacuation drill being completed was recorded. In discussion with the Manager she stated that this has been completed for the year but it was not recorded.
Corrective Action(s): Please ensure to record the emergency evacuation drill after it is completed to comply with the legislation.

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: While reviewing the children's records licensing observed an electronic record of an incident that occured at the facility that had not been reported to licensing. In reviewing the records at the FHA office, their was no record of the incident on file.
Corrective Action(s): Please ensure to notify licensing within 24 hours after a child is involved in a reportable incident described in Schedule H of the CCLR.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: During the inspection licensing reviewed 26 children's records of 105 records. Two children's files were missing a record of immunization.
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Licensing reviewed 26 children's records of 105 records. Thirteen records were missing a date of enrollment.
Corrective Action(s): Please ensure children's files are complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: During the inspection 26 children's records of 105 records were reviewed. Four children's files were missing a doctor's name. In discussion with the Manager she stated some children are new to the country and do not have a doctor yet. Licensing recommended the families add the name of a medical clinic to the child's records. In addition, four children's records did not have an emergency contact other than the parent.

Comments

At the inspection dated November 19, 2019 and November 21, 2019 there were 86 children and 17 staff and one Manager present . At this inspection the above noted contraventions were identified. Please ensure a written response is submitted to licensing by December 5, 2019 stating how you have addressed the above noted contraventions. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:
· Promoting Active Play in the program
· Temporary Placements
· Active Supervision
· Lead in the Water. There is a separate water source for children.
· More items are needed for the emergency evacuation supplies. Licensing recommends enough food, water and supplies for a period of 72 hours
· Items with a Drug identification number (DIN) or a Natural product Number (NPN) were removed from the first aid kit as a medical authorization is needed to apply these items.
· No nutrition policy was noted on file. This was discussed.
· Using an additional lock for the playground gates as the playgrounds are close to a busy street.

This inspection was completed on November 19, 2019 and November 21, 2019. The report was reviewed with the Manager prior to signing on November 21, 2019.
