Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Contraventions
Previous Inspection - Contraventions observed on FIR #SWAR-AD3M3Y have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: On review of 2 staff files, Licensing observed that both were missing immunization status.
Corrective Action(s): Please ensure status is known of all staff employed to work with the children. Licensing will email an immunization form to the Licensee for use.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: In discussion with the staff member on site today, this staff has not yet practiced a fire drill at this facility and has been emplyed here since February 2017. The staff is knowledgeable as to the procedure for evacuation and where to evacuate to
Corrective Action(s): Please ensure all staff practice the fire drill at least monthly.

STAFFING: 12250 - CCLR s.29(b) - To qualify for employment in a community care facility as a responsible adult, a person must (b) be able to provide care and mature guidance to children.
Observation: Licensing observed the staff present today, interacting with the children. Licensing observed that the staff did not model appropriate meal time behaviour and was observed walking around the room eating lunch and did not wash her hands prior to eating. The children were allowed to stand, walk around and have equipment at the table whilst eating which is a potential choking hazard. Licensing observed the staff using the consequence of not having something if they refused to cooperate or listen. This is not appropriate role modelling for this age of children.
Corrective Action(s): Please ensure staff are guided in appropriate role modelling to provide mature care and guidance to the children.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed that the fire drills have not been recorded since May 2017. This is a repeat contravention
Corrective Action(s): Please ensure fire drills are recorded when practiced

CARE AND/OR SUPERVISION: 14230 - CCLR s.51(1)(b) - A licensee must (b) provide to employees and parents a written statement of the licensee's policy on behavioural guidance.
Observation: Licensing requested a copy of the facility policies and staff was unaware of where they were located and stated that she had never seen them.
Corrective Action(s): Please ensure that all staff are orientated in the facility policies and procedures and have access to a copy of all relevant documentation.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed that children did not wash hands prior to eating lunch. They went straight from one activity to lunch. Tables were not cleaned prior to the children sitting down for lunch but were cleaned afterwards. Staff also didn't wash hands prior to eating lunch.
Corrective Action(s): Please ensure staff are instructed in health and hygiene practices

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: On review of a random selection of 6 children's files, Licensing observed that 1 was missing immunization status.
Corrective Action(s): Please ensure all children's files are complete.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: On review of a random selection of 6 children's files, Licensing observed that one was missing a digital image. This is a repeat contravention.
Corrective Action(s): Please ensure that all children have a digital image on file to readily identify the child in case of emergency

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was a Responsible Staff member with 9 children in the School Age Summer Program. The Licensee/Manager works for 3 hours per day in the mornings during Summer.
Staff to child ratio was in compliance with regulations
Programming is posted and available for parent review and children's work is displayed on the walls.
Licensing observed Staff engaged with children during lunch time and free play activities.
Licensing observed the children having more than 30 minutes of screen time. 1 child was watching TV and 6 children were engaged in hand held devices and a laptop. 2 children were involved in free play - all prior to having lunch.

Discussions with the Staff:-
- Licensing reviewed the expectation of the Director of Licensing Standards of Practice for Active Play which also includes a maximum of 30 minutes of screen time per day with the staff.
- Licensing recommends that the Licensee re-evaluate staffing orientation and training.
- Please ensure sanitization products in spray bottles is labelled correctly. It is inaccessible to children, stored in a cupboard.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection will be conducted due to the number and nature of the contraventions.

Some areas of this inspection report was reviewed with the Staff member on site today.
