Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP).
All areas of the facility were reviewed for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed that several areas of carpeting and rugs were dirty in places and in need of a deep clean/shampoo. Particularly in the Group Child Care under 36 month program.
Corrective Action(s): Please ensure that all surfaces, particularly where children are crawling and playing are clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: Licensing observed in the outdoor play space of the Group Child Care 30 months to school age program a piece of equipment (an underground tunnel structure) was lacking in resilient surfacing on the top of the structure which children access. There is protruding concrete rather than resilient surfacing and this is a concern to the safety of the children when playing on the surface.
Corrective Action(s): Licensing recommends adding a new resilient surfacing to the area to ensure freedom from harm. Please provide a written compliance plan to licensing by the date below.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: On review of 9 staff files, Licensing observed that the Licensee was missing a resume in the file.
Corrective Action(s): Please ensure all staff files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: On review of 9 staff files, Licensing observed that 1 was missing immunization status.
Corrective Action(s): Please ensure all staff files are complete at the time of employment

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: On reveiw of 9 staff files, Licensing observed that 2 staff were missing current certificate verifications. Licensing acknowledges that all other certified staff had verification evidence on file.
Corrective Action(s): Please ensure all staff files are complete at the time of employment.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Licensing observed that the fire drills for December were not conducted by staff.
Corrective Action(s): Please ensure that staff practice implementing the fire drill procedure once a month.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: On review of 9 staff files, Licensing observed that 2 were missing current cleared criminal record checks. Licensee contact/Manager has received the online code for herself to obtain her clearance and has also requested the staff to complete hers.
Corrective Action(s): Please provide a health and safety plan in relation to the staff requiring update to Licensing by the date below.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: In discussion with staff and through observation, Licensing observed that emergency evacuation supplies were not in place for the facility. This was discussed at a previous inspection and resources were recommended for obtaining adequate supplies. This has not yet been facilitated and the supplies on site would not be sufficient for the facility to effectively respond in an emergency
Corrective Action(s): Please ensure emergency supplies are in place to sustain all children on site for up to 72 hours. Please provide licensing with a compliance plan, by the date below as to when this will be completed.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: On arrival, Licensing observed that the safety gate for the Group Child Care under 36 month program was open and 3 children were exiting into the hallway. The supervising staff was further into the room unaware of the incident.
Corrective Action(s): Please ensure that staff appropriately supervise children at all times.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed that in the Group Child Care 30 months to school age program, bedding was stored in bins for 2 children at a time which is a cause for concern in cross contamination as the bedding is constantly touching. Licensing did note in the infant/toddler program, bedding is separated individually.
Corrective Action(s): Please ensure all bedding is stored individually

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Of the 12 children's files that were reviewed, Licensing observed that 2 were missing digital images.
Corrective Action(s): Please ensure that all children's files contain the required information at the time of registration.

Comments

Summary of Inspection

At today’s inspection there were 22 children and 6 staff present. At this inspection the above noted contraventions were identified.
Licensee is required to respond to the above contraventions by January 22nd 2019. A compliance plan is also required as well as a health and safety plan by January 17th 2019.
Licensing Officer will follow up with an inspection to ensure compliance once a response has been received.
As part of this Routine Inspection a Facility Risk Assessment Tool was completed and a copy was provided.
