Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed four staff files. Two files did not contain valid criminal record checks.
Corrective Action(s): Ensure all staff files are complete.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed four staff files. One file did not contain evidence of completed reference checks.
Corrective Action(s): Ensure all staff files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Licensing reviewed four staff files. One file did not contain evidence of the employees immunization status.
Corrective Action(s): Ensure all staff files are complete.

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: In one of the child care rooms there were 23 children supervised by 2 early childhood educators and a responsible adult. This does not meet the required staffing requirements. The manager stated that although the responsible adult was being used in ratio today, the staff member is usually used as an extra staff on the floor.
Corrective Action(s): Ensure that children are supervised by qualified employees as per the child care licensing regulations.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: During today's inspections Licensing identified the following:
-Two children have allergy medication on site but did not have a care plan created to identify the course of action recommended in the event the children required the medication to be administered.
-One child's file indicated that the child required medication for an allergy, however the staff were unaware of this information.
Corrective Action(s): Develop care plans in consultation with parents for children with severe allergies; outlining symptoms to watch for and the course of action recommended in the event the medication is required.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Licensing reviewed one current care plan in place. The care plan has not been reviewed with the parent within the past year.
Corrective Action(s): Ensure to review care plans yearly with the child's parent.

Comments

At this inspection there were 44 children, the Manager and six staff present. At this inspection the above noted contraventions were identified. The Manager is required to take corrective action to bring the facility in to compliance and provide a written response to Licensing by January 24, 2020. As discussed during this inspection Licensing will mail the facility some resources on creating care plans. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
-Sanitizing practices
-Advertising
-Care plans

The following resources were provided:
-Universal precautions poster
-Guidance in the selection of cleaners, sanitizers and disinfectants
-3 step dishwashing poster
