Introduction

An announced routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance with a focus on health and hygiene practices during the COVID-19 pandemic.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
- A utility room accessible to children containing chemicals and cleaning supplies on a low shelf. The utility room has the ability to be locked, however, at the time of inspection the door to the utility room was unlocked and open (Corrected during inspection).
-A bottle of bleach on the counter next to the children's handwashing sink (Infant/toddler bathroom).
-Damaged fence in the infant toddler outdoor play space. Please submit a health and safety plan in regards to infant/toddler outdoor play space as discussed.
-Garbage and debris in the infant/toddler outdoor play space.
Corrective Action(s): Ensure that a healthy and safe environment is provided at all times while children are in care of employees.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Upon an inspection of three staff files, it was noted that none of them had a valid CRC.
Corrective Action(s): Ensure that valid, site specific CRCs are in place before start of employment. Please submit a plan to licensing which outlines how the facility will come into compliance.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Upon an inspection of three staff files, it was noted that staff certificate validations were not available for inspection.
Corrective Action(s): Ensure staff certificates are validated and available for inspection.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: Licensing noted that three children (2 school age and one toddler) were in the I/T program with one educator. The Manager was not present at the time of Licensing arrival.
Corrective Action(s): Ensure that children attending the care facility are divided into groups in accordance with schedule E of Child Care Licensing Regulation.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Photos were not available for the purpose of readily identifying children in the event of an emergency.
Corrective Action(s): Ensure that digital image or photograph is present for each child for the purpose of readily identifying in an emergency.

Comments

Summary of Inspection:
At the inspection dated Sep-9-20, there were 3 children in care with 1 educator. The manager arrived at the facility 20 minutes after Licensing's arrival.
A COVID-19 Risk Screening was conducted at the facility as attempts to contact the facility via telephone had gone unanswered.
At the inspection, the above noted contraventions were identified.
Please provide Licensing with a written response, by the date noted below, stating how the identified contraventions will be addressed in order to ensure year round compliance.
As part of this Routine Inspection a Facility Risk Assessment Tool was completed.
This report was written off site due to COVID-19 safety practices. The contraventions identified in the report were reviewed with the Manager before Licensing's departure.
Licensing returned to the facility on September-10-2020 as a need for education and support was identified.
A copy of this report and the corresponding Risk Assessment was emailed to the Manager.
The following items were discussed:
-Planned emergency response during COVID-19.
-Communicable disease prevention practices.
-Health/hygiene/sanitizing practices during COVID-19 which included review of cleaning and sanitizing as multiple steps and review of proper diapering practices.
-Products with medicated ingredients and DIN numbers in First Aid kits require parental consent.
-The facility currently uses a modified system to sign children in and out due to COVID-19. Legislative requirement of recording children's time of arrival and departure is being met.
-Facility contact information (phone number, licensee contact, manager information and email) was provided by the Licensee as it differs from what Licensing has on file. Updates have been made to the facility file.
-Reportable incident procedure was explained to the Manager.
-Temporary placement and exemption process was reviewed with the Manager.
-Duty to inform discussed with the Manager.
-Requirements for a COVID-19 safety plan for staff and children to be developed and posted was discussed.
-A COVID-19 Infection Control Assessment was conducted.
