Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: An old License was posted by the entrance to the facility documenting that it was operating with more care programs.
Corrective Action(s): Ensure that the current Licence is posted in a prominent area.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: It was observed that the paint was chipping exposing gyprock in 2 classrooms accessible to children.
Corrective Action(s): Ensure that the facility is in good repair while children are in attendance.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11060 - CCLR s.14(2) - A licensee must have one toilet and wash basin for every 10 children or fewer.
Observation: In 2 Group Child Care (under 36 month) programs the toilets were being used as storage areas. A photo was taken in one of the classrooms and can be provided to the facility upon request. In one of the classrooms a sink was also inaccessible.
Corrective Action(s): Ensure that there is one toilet and one washbasin is available for every 10 or fewer children.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: 1 of 7 staff files reviewed did not have an educator or assistant certificate verified.
Corrective Action(s): Ensure that each employee has the educator or assistant certificate verified.

STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation: 1 person who is ordinarily present does not have a criminal record check.
Corrective Action(s): Ensure that each person employed has a criminal record check.

STAFFING: 12153 - CCLR s.19(5)(c) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (c) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: 1 person who is ordinarily present did not have any evidence of compliance with the province's immunization and tuberculosis control programs.
Corrective Action(s): Ensure that each person employes has evidence of compliance with the immunization and tuberculosis control programs.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: 2 programs diaper change mats were in poor repair with the material ripping and foam exposed. The mats are unable to be properly sanitized between uses.
It was observed that there were high chairs and nap cots stored in one of the bathrooms.
Corrective Action(s): Ensure that the diaper change mats are in good condition and can be sanitized between uses. Please ensure that the high chairs and nap cots are not stored next to toilets.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: One child who had medication administered did not have a specified time to give to the child.
Corrective Action(s): Ensure that the medication is administered in the amount and at the time specified by the child's parent.

MEDICATION: 16020 - CCLR s.53(1)(b) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (b) readily accessible to employees.
Observation: A child with a care plan did not have the medication readily accessible. Another child with a care plan had medication that was expired.
Corrective Action(s): Ensure that any medication agreed to be given to a child is readily accessible to an employee.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: 12 of 28 children's files reviewed did not have a photograph or digital image of the child that could be used to readily identify the child in an emergency. All children had photographs, however, the children looked different.
Corrective Action(s): Ensure that each child has a photograph or digital image to readily identify the child in an emergency.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: 2 children requiring care plans did not have a care plan completed in full in consultation with a parent.
Corrective Action(s): Ensure that each child requiring a care plan has it completed.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: One care plan was not reviewed within the last year. This is a repeat contravention.
Corrective Action(s): Ensure that each care plan is reviewed at least once per year.

Comments

Summary of Inspection
At the inspection dated July 16, 2021 there were 53 children, 17 staff and 1 person ordinarily present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by July 30, 2021. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
· Records being available
· Care Plans
· Emergency exits accessible at all times
· Cleaning protocols using soap and water to wash and sanitize afterwards
· Ensuring there is adequate toys and materials available for children to access.

· Systems to identify when certifications expire
