Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

At time of this inspection all areas inspected were found to be in compliance with the exception of those noted below:

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Current staff qualification certificates are not displayed for 2 staff on site at time of inspection.
Corrective Action(s): Please ensure current certifictaes are posted when staff qualifictaions change. Current certifictaes were in the staff file.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The area immediately outside the exit door which leads to the outdoor play areas is very cluttered with garden hose posing a tripping hazard, electrical extension cord, bucket full of water, and number of play equipment not in use. The clutter also poses a risk to the children's health and safety as it may hamper emergency evacuation if required. Inside in the Daycare Room #1 has small blind cords/chains dangling and accessible and pose a risk of injuryto children as the anchor to hold them in place is broken.
Corrective Action(s): Please ensure the outside entrance area to play areas is not cluttered to ensure the children's health and safety and equipment not in good repair that is not in use is not stored in this area to ensure it is not accessible to children. Also please ensure the blind cords are anchored to prevent risk of injury.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Eleven staff files were reviewed and validatation of staff qualfication certificate is missing for 2 staff.
Corrective Action(s): Please complete as per requirements.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: There are 2 children in the Group Child Care (under 36 months) program who do not meet age requirements; and further there is one child in the Group Child Care (30 months to school age) program who does not meet age requirement of the program.
Corrective Action(s): Please ensure children meet age requirements of all programs or ensure approval has been obtained from Licensing for the temporary placement and/or retention as per legislative requirements.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Staff qualifictaions do not meet requirements in the Group Child Care (under 36 months) program as there was no Infant Toddler Educator in one program.
Corrective Action(s): Please ensure staff meet qualification requirements in each program as per CCLR and as discussed.

CARE AND/OR SUPERVISION: 14280 - CCLR s.52(1)(c) - A licensee must ensure that a child, while under the care or supervision of the licensee, is not subjected to any of the following: (c) harsh, belittling or degrading treatment by an employee or another child, whether verbal, emotional or physical, that could humiliate the child or undermine the child's self respect.
Observation: There are 3 log book entries that indicate guidance used was harsh for management of behavior.
Corrective Action(s): Please ensure staff implement guidance and treatment as per CCLR and facility guidance policy and ensure guidance is age and developmentally appropriate.

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: Log book record indicates a restraint was used to ensure the safety of a child, but no notification was provided to Licensing of this reportable incident as per CCLR.
Corrective Action(s): Please ensure reportable incident notifictaion is provided as per requirements. Discussion took place with the Manager regarding completion of care plan if use of restraint is required on an on-going basis and for submitting reportable incident report when an emergency restraint is used for ensuring child's safety.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Twelve registration files for children were reviewed and the enrollment date is missing for 2 children.
Corrective Action(s): Please review all records to ensure they are complete s per requirements.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Departure time is missing for some days on attendance records.
Corrective Action(s): Please ensure attendance records are complete daily and indicate arrival and departure time for all children.

Comments

At time of this inspection the following was also observed and or discussed:
--At time of this inspection the 3 Group Child Care (under 36 months) and (30 months to school age) programs were operating. Staff ratios were in compliance with the exception of that noted above.
--Children were observed engaged in circle, snack, free play, art, story time and going outside in all programs. Staff in the Group Child Care (under 36 months) program were observed sitting on the floor engaged with the children in their play, holding children in their lap and interacting with them and comforting children when required. Monthly theme for activities is posted and a daily report of the child's day is provided to the parents. Staff in the Group Child Care (30 months to school age) were observed interacting with the children and appropriate language and positive guidance was used to guide children.
--Medication consent forms are in use , however please ensure directions provided on consent forms provide more details to ensure clarity for use of medication unless a care plan is required.
--Facility has completed the new policies for Active Play and Screen Use and policies have been provided to the parents. Facility is meeting requirements for the new policies.

--Immunization poster provided
A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
