Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following in classroom one that is licensed for 30 months to school age;
The fabric of small rocking chair has holes in it. The staff stated that they will put the cover on the rocking chair.
One of two sinks in the washroom was rusty and showing signs of tear and wear.
Corrective Action(s): Ensure physical facility is clean and in good repair while children are in attendance.
Date to be Corrected: The manager will provide a written response to address this contravention by January 2, 2019.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Random review of 5 staff files observed one staff was missing a site specific CRC on file. There was a signed consent dated in July; however results were not on file. The manager stated that they will follow up CRC agency to obtain copy of valid CRC for staff.
Corrective Action(s): Ensure staff files are complete

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: The sleep mats in all rooms were stored in a manner that they were touching each other and posing the risk of cross contamination of germs. The manager stated that they will remove and store the mat sheets separately to ensure health and safety of children.
Corrective Action(s): Ensure to practice the rules of health and hygiene.

MEDICATION: 16080 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: Classroom one first aid kit contains an expired medication for a child in care. The manager will contact the family to replace the medication.
Corrective Action(s): Ensure to promote health and safety of children in care.

Summary of Inspection
At the inspection dated December 19, 2018 there were 41 children in attendance in different rooms and 10 staff members were working on site. At this inspection the above noted contraventions were identified. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The manager will send a written response to licensing by January 2, 2019 to address above noted contraventions.
