Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP).
All care categories were inspected for compliance

Contraventions

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the outdoor play area to have a fence slat missing where a child could get a foot or hand stuck. The Manager ssid that she is conversing with the neighbours around replacing the fencing in time.
The gate leading down to the garage had a large gap underneath where a child could crawl through - this leads to concrete steps which increases the risk of injury.
Corrective Action(s): The Manager hung netting over the gap to make this inaccessible.to children. Please ensure the fence gap is inaccessible to children.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for more than one employee
Corrective Action(s): Please ensure staff files are complete with the required documentation as per Section 19.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed that the fire extinguisher was overdue for service. The Manager said that she will have someone come out to service it. This is a repeat contravention.
Corrective Action(s): Ensure that the fire extinguisher is always serviced annually

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: Licensing observed that the facility policies regarding care and supervision were not available on site for staff review. On review of the parent handbook it was observed that these policies were not included. This is a repeat contravention. The Manager said that she remembers creating these policies during the application process
Corrective Action(s): Please ensure a copy of all facility policies relating to the care and supervision of children be available to staff and parents.

MEDICATION: 16020 - CCLR s.53(1)(b) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (b) readily accessible to employees.
Observation: Medication was not readily accessible to employees when off site. This is a concern should the child require immediate medical assistance.
Corrective Action(s): Please ensure that a child's medication is accessible for staff to administer at all times

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: In discussion with the Manager, it was identified that although any minor incidents are communicated to parents via phone or text, current records were not available for review. The Manager said that they write incidents down, but was unable to retrieve that information during the inspection.
Corrective Action(s): Please ensure a written record is maintained for minor incidents and is available for all staff and for review.

RECORDS AND REPORTING: 19051 - CCLR s.56.1(2)(a) - A licensee must keep (a) a copy of the written statement, referred to in section 19 of the Act, that the licensee delivers to persons who prepay part of the cost of services
Observation: Licensing observed that there was no record of the prepayment agreement to parents on review of children's files. This was further discussed and the requirement explained with the Manager.
Corrective Action(s): Please ensure a copy of the prepayment agreement is in place for all families.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: On review of children's files, Licensing observed that one child currently in attendance, did not have a registration file on site. Licensing acknowledges that emergency contact information is available for this child.
Corrective Action(s): Please ensure that all required docmentation is in place prior to the child attending without parents

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: A care plan does not include the course of action recommended by health care professionals for a child requiring additional support, or signs and sypmtoms to look out for.
Corrective Action(s): Please ensure staff are provided with a detailed care plan that provides indicators of signs and symptoms to look out for in order to appropriately provide the additional support required

Comments

At today’s inspection there were 5 children and 2 staff present. The Manager was on site to assist with the inspection while the group was out on a walk, until they returned.
Licensing reviewed the facility’s COVID-19 prevention strategies

At this inspection the above noted contraventions were identified and the Licensee is required to submit a written compliance plan by the date below.
As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

The following was discussed:
- Hygiene and sanitization practices when hand washing with cold water and ensuring comfort of the child
- Substitute staffing qualifications
- Nap mat placement to ensure separation at all times
