Introduction

An unscheduled follow up inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). This follow up is part of the first year of monitoring as a new facility.
Areas of non-compliance identified at the last routine inspection were reviewed today and had been addressed.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11480 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: Licesning observed a napping child in the downstairs nap room, that was occasionally checked on by staff while the rest of the group were outside. The nap room door was open along with the bathroom door, in which the cupboard door was unlocked. This cupboard held hazardous materials such as Clorox and laundry detergent. This poses a risk of harm to the children in care.
Corrective Action(s): Please ensure that the facility is operated in a safe manner, mitigating any risk to the children in care.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: On review of staff files, Immunization status was not obtained for one employees.
Corrective Action(s): Please ensure all staff files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: On review of staff files, Licensing observed that one staff file who was ECE certified, was missing validation.
Corrective Action(s): Please ensure staff files are complete

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Licensing observed that an Agency staff on site today did not have documentation of the requirements of Section 19 on site. Staff did say that all documents had been provided to the Manager but Licensing was unable to locate this information. Staff did provide a copy of most required documents held on a digital device, but no copy of CRC.
Corrective Action(s): Please ensure all documentation for each employee is available for review on site at all times when employee is present. Please submit a compliance plan as to how this will be addressed.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: In conversation with the staff, Licensing learned that the opening staff did not have the required qualifications as per Schedule E until the substitute staff arrived at lunchtime. Appropriate staff qualifications were discussed at the routine inspection as being a concern, and was addressed in the response to Licensing.
Corrective Action(s): Please ensure staffing qualification meet the requirements of Schedule E at all times. Please provide a compliance plan to Licensing.

Comments

At today's inspection there were 4 children and 2 staff present. The Manager was not on site and staffing was provided by a substitute staff and an agency staff.
At this inspection the above noted contraventions were identified
The Licensee is required to respond to the contraventions with a compliance plan by the date below.
