Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Licensing observed that the name of the manager was not posted in a prominent place in the facility. This is a repeat contravention, and was identified on July 28, 2021 on routine inspection report #MZIN-C5ET6Y.
Corrective Action(s): Ensure that the name of the manager is posted in a prominent place inside the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed a few rotting wood boards in the outdoor play area. These boards which appeared to have mold, were attached beside the railings of the stairs, and other ones were laying on the ground beside the outer wall of the house. The manager stated that the rotten wood board attached to the railings of the stairs will be replaced. This item is a repeat contravention, and was identified and contravened on July 28, 2021 on routine inspection report #MZIN-C5ET6Y.

In addition, Licensing also observed in the outdoor play area that a wood slat of the fence was detached leaving a gap on the fence. The wood slat was then placed vertically leaning up against the fence, which could potentially fall on children while playing. The manager stated during the inspection that the fence wood slat has been detached from the fence due to high wind.
Corrective Action(s): Ensure that the rotting wood boards are all removed from the outdoor play area, as it poses a health hazard to children while playing in the area.

Furthermore, ensure that the wood slat is not leaning up against the fence and that the wood slat is to be placed back to make sure there are no gaps on the fence.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed that the garden hose outside the play area was unravelled which could pose as a tripping and strangulation hazard while children are in the outdoor play area.

In addition, Licensing observed an exposed nail beside the railings of the stairs, which is within reach of children as they come down the stairs.
Corrective Action(s): Ensure that the garden hose is rolled up and placed out of reach from children.

Ensure there are no exposed nails within reach of children outdoors.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of a person's work history (resume) was not obtained for one employee.
Corrective Action(s): Ensure that the resume of the employee is included on file.

HYGIENE AND COMMUNICABLE DISEASE: 15010 - CCLR s.14(4)(a) - A licensee, other than a licensee who provides a care program described as either Preschool (30 Months to School Age) or Group Child Care (School Age), must have in a community care facility a sturdy surface for changing diapers, located outside the food preparation area, next to (a) a covered container for soiled clothing.
Observation: Licensing observed that in the bathroom, the lid of the garbage bin for soiled diapers has been removed. The lid was placed just beside the garbage bin. This item was identified and contravened on Apr. 21, 2020 on routine inspection report #JKIM-BNVSFK.
Corrective Action(s): Ensure that the lid of the garbage bin for soiled diapers is placed back.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Licensing observed that one child did not have the doctor's phone number listed on file. This item was previously contravened and identified on Apr. 21, 2020 on routine inspection report #JKIM-BNVSFK.
Corrective Action(s): Ensure that the doctor's phone number is also included on file. The manager stated during the inspection that this information will be retrieved from the parents.

Comments

At the inspection dated June 07, 2022 there were 7 children and 2 staff present. The manager was also on-site and assisted with the inspection. At this inspection, the above noted contraventions were identified. Actions required by the licensee includes a written response. The contraventions noted in this report were reviewed with the facility during the inspection.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations/discussions were provided:
- Reportable Incident procedures, which is to be reported within 24 hours. Child care staff are asked to call their Licensing Officer to make the report. If the Licensing Officer is unavailable, please call the Duty Line.
- Continue to document minor incidents using the incident log bound book, and take note of any illness and unexpected events involving children not requiring medical attention, and that are not reportable incidents as described in Schedule H and staff to initial and date after each documentation
- Continue to constantly review facility policies
- Continue to clean and sanitize the facility including toys and equipment
- Check the expiry date of items in the emergency supplies kit
- Licensing requirements, regulations and procedures
- Organization of files, which is to be placed in a designated place in the facility for easy access
