Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation (CORRECTED DURING INSPECTION): The diaper change pad in room 2 had a tear between 1-2inches in the plastic material, making it unable to be properly sanitized. The Manager corrected this on site by replacing the diaper change pad.
Corrective Action(s): Ensure that all furniture, equipment and fixtures are clean and in good repair.

STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation: A criminal record check was not obtained for one volunteer.
Corrective Action(s): Ensure each volunteer has a criminal record check.

POLICIES AND PROCEDURES: 13080 - CCALA s.19 - If a person prepays part of the cost of services provided by a class of community care facilities designated by the Lieutenant Governor in Council, the licensee must, at the time of the prepayment, deliver to the person a written statement setting out the terms and conditions on which a refund of all or any of the prepayment will be made.
Observation: The Licensee did not provide a written statement outlining the terms and conditions of refund to a person at the time of prepayment. The Licensee contact created a prepayment policy during the inspection and will post the notice for all parents. He will create a document for parents to acknowledge that they've read it.
Corrective Action(s): Ensure each person who prepays is given a written statement outlining the terms and conditions on which a refund will be made.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: ratio of employees to children attending the facility is less than permitted in Schedule E.
Corrective Action(s): Ensure that the ratio of employees to children attending is no less than permitted in Schedule E.

Comments

Summary of Inspection
At the inspection dated June 16, 2022 there were 23 children, 7 staff, and 1 volunteer present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:

· Active Supervision
· Lead in the Water
