Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Contraventions
Previous Inspection - Contraventions observed on FIR #SREL-AMNP9A have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
- All couner tops were cluttered with a variety of equipment such as art supplies; children's water and other equipment.
- On Licensing's arrival, the safety gate was not present at the bottom of the stairs to the upper floor - this was therefore accessible to children. Licensee did correct this during inspection.
- Electrical sockets were uncovered in the nap room in which children were sleeping unsupervised
Corrective Action(s): Please ensure a safe and healthy environment at all times during children's attendance

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11110 - CCLR s.15(2)(b) - A licensee must ensure that each piece of furniture or equipment for sleeping (b) is clean and comfortable.
Observation: Licensing observed that the blanket/bedding used for the children was stored alltogether in one travel crib. Licensee stated that after nap time the previous day, children were asked to tidy up the bedding and they placed it all in one crib. Licensee had yet to sort it and stated that it is generally stored in individual containers.
This is a repeat contravention
Corrective Action(s): Please ensure all bedding for each child is stored separately at all times to prevent cross contamination.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: Licensing observed several paving stones in the outdoor play space that were loose and protruding at angles which were a cause for concern as a tripping hazard. This had been identified at a previous inspection, both a routine and a complaint inspection and Licensee had statd that quotes had been received to level the ground and put down pea gravel as a resilient surface.
At today's inspection, Licensee stated that a parent would be completing work on a new pathway in a months' time.
This is a repeat contravention
Corrective Action(s): Please submit a compliance plan to Licensing to address this concern by the date below. Please ensure supervision is fully maintained during outdoor play

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Licensing observed that Licensee does not keep a file on site for herself. Licensing was unable to verify immunization status; resume; references; or ECE validation.
Licensee's criminal record check (CRC) expired in November 2017 and has yet to be renewed.
Licensing acknowledges that a current ECE certificate is posted along with current first aid certification.
Corrective Action(s): Please ensure a current staff file is always on site for any staff working in the facility. Licensing will provide the Licensee with the online code for CRC application

POLICIES AND PROCEDURES: 13010 - CCLR s.22(1)(a) - A licensee must have all of the following: (a) emergency exits and a fire drill system approved by a local assistant within the meaning of the Fire Services Act.
Observation: Licensing observed that the fire extinguisher did not have a date of service attached. Licensee stated that it has been recently purchased in January 2018.
licensing also observed that the smoke alarm in the main play space was missing. Licensee stated that the batteries were being changed on this piece of equipment.
Corrective Action(s): Please ensure a date of purchase is placed on the extinguisher to ensure a visual reminder of annually required service.
Please ensure smoke detector is replaced immediately to ensure the health and safety of the children.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed the following:
- No children washed their hands prior to eating snack
- Tables were not sanitized prior to eating or after eating and had previously been used for art activities during inspection
Licensing did observe a child washing hands after using the washroom and then the group washing hands after circle time before eating their lunch.
Corrective Action(s): Please ensure children are instructed in healthy hygiene practices at all times.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Licensing could not review facility policies and procedures as Licensee stated that the last physical copy was given to a parent. Licensee stated that she would provide Licensing a copy of policies and procedures by email.
Corrective Action(s): Please ensure a copy of facility policies and procedures is available at all times particularly to guide any substitute staff if required.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was the Licensee with 7 children

Staff to child ratio was in compliance with regulations
Programming is posted and available for parent review
Licensing observed the children in free play, art activity, circle time, snack and lunch time.
Discussions with the Manager/Licensee:-
- Licensing reviewed the requirements of staff files with the Manager
- Licensing provided information regarding Appetite to Play and provided the immunization poster as a resource
- Licensing recommends printing photos of the children for ease of access.

Licensing observed Staff engaged with children during all activities. Appropriate supervision and guidance was observed.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection may be conducted due to the number and nature of the contraventions.
