Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Licensing observed that the name of the manager is not posted.
Corrective Action(s): Ensure the name of the manager is posted for families to see.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Licensing observed that two out of three staff certificates were posted.
Corrective Action(s): Please ensure certificates are posted for each staff member. This was corrected during the inspection.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following inside the facility:

Plastic chairs stored on top of a high cupboard (high use area). This could pose a risk if they fall. Corrected during inspection.
One plug cover was missing (immediately fixed by manager).
The fridge temperature measured over 6 degrees - too warm.
Cleaning supplies (broom, dustpan) were accessible to children.
The Manager and staff stated that the bibs and the dishes that children use in the facility are washed with soap. Through discussion Licensing confirmed that no disifection step is taken.
The high chair trays were washed with a cloth after use, however there was not a disinfection step.
Inconsistent practice of disinfecting the diaper change mat - while it was seen to be disinfected on some occassions after use, it was also seen to be put away after use without a disinfecting step.
The children had their diapers changed, however did not wash their hands after.

One of the two emergency exits did not have a key (required to open the door). The Manager and 1 staff were aware of the location of the key. This may pose a risk in the event of an emergency evacuation.
Several children under the age of two (approx 1 year) were provided cherries and grapes (whole) posing a choking hazard
Several infants and toddlers mouthed many blocks over a half hour period. Licensing observed the staff putting the mouthed blocks away with the clean blocks.

Licensing observed the following outside the facility:

Carpet covering the play area is ripped and has bumps. This may be a tripping hazard for new walkers.
A fence and a gate has wooden panels missing and has rusty staples exposed.
Prickly weeds and a holly bush are accessible to children. No berries are on the holly bush at this time but they are toxic to humans.
The stairs leading to the upper deck are accessible to children.
An extension cord and holiday lights were hanging at a low level, and the plugs were wrapped in plastic (wet from rain).

Licensing requires that the outside play space be corrected prior to the children accessing this area.

Corrective Action(s): Please ensure a healthy and safe environment is provided for children at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11180 - CCLR s.16(4)(a) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (a) suitable for the age and development of the children.
Observation: The manager stated that she places children (1 to 2 years) one at a time on a large trampoline. Licensing noted that the manufacturer's web site recommend that this equipment not be used for children under the age of 6. Licensing also noted that Health Canada does not recommend trampoline use for this age group.
Corrective Action(s): Ensure equipment is suitable for the age and development of children.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following:

Diaper cream accessible to children on a low shelf in the bathroom
A toilet brush on the ground near the toilet (uncovered)
A metal snow shovel with a very sharp metal edge
A lawnmower
Many pieces of wood in a pile on the ground with rusty screws sticking out
A rusty nail sticking out of the side of the wall beneath the deck in access to children.
Rusty nails at the base of the house. Although pointing down, they are still accessible to a small child
Corrective Action(s): Please ensure children do not have access to any object or substance that may be hazardous.
Date to be Corrected: August 29th, 2018

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing inspected three staff files two of which did not have CRC obtained from the Criminal Record Review Program. One was obtained from a third party and one was obtained from the local police department. This is a repeat contravention.
Corrective Action(s): Please ensure the CRC's on file are obtained from the Criminal record review program and specific to this licensee.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing observed three staff records. One staff record was missing one character reference.
Corrective Action(s): Please ensure that all character references are checked prior to employment.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Three staff files were inspected. One staff file was missing a record of the person's work history.
Corrective Action(s): Please ensure all staff have a record of their work history on the staff file prior to employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Three staff files were reviewed. Two staff files were missing immunization records.
Corrective Action(s): Please ensure all immunization records are obtained prior to employment.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: The manager stated that staff certificates have not been validated. The manager stated that an attempt was made.
Corrective Action(s): Ensure staff certificates are validated.

STAFFING: 12180 - CCLR s.22(2)(a) - A licensee must ensure that each employee (a) is trained in the implementation of the fire drill system and emergency plan described in subsection (1), including the use of any equipment noted in the fire drill system and emergency plan.
Observation: The Manager was unaware of the emergency meeting location that was outlined in the emergency plan. The Manager stated that the emergency meeting location was at a four way stop in contrast to the elememntary school that was documented in the emergency plan. There was no documentation or evidence to show that the emergency plan had been practiced.

Licensing inspected the emergency supplies and noticed their was not enough food for the children in care, and some food in the emergency kit was expired.
Corrective Action(s): Please ensure the staff are familiar with the policies and the supplies in the emergency kit are sufficient for the amount of children in care.

POLICIES AND PROCEDURES: 13071 - CCLR s.56(2) - A licensee must ensure that the policies and procedures referred to in subsection (1) are implemented by employees.
Observation: The manager who works with children stated that she has not yet reviewed the policies and procedures for this facility (was unsure where these were kept). One staff stated that she was provided with these, however another staff was not sure.
Corrective Action(s): Ensure policies and procedures are implemented by all staff at this facility who work with children.

POLICIES AND PROCEDURES: 13100 - DLSOP Active Play - The Licensee must develop and implement an Active Play Policy to engage children in daily active play, consisting of un-facilitated play and facilitated games and activities.
Observation: The manager stated that there is not an active play policy in place.
Corrective Action(s): Please develop, implement and provide to parents an active playt policy.

POLICIES AND PROCEDURES: 13120 - DLSOP Active Play - The Licensee must develop and implement a Screen Use Policy to guide employees in the use of screen time activities.
Observation: The manager stated that a screen use policy has not been developed.
Corrective Action(s): Ensure that a screen use policy is developed, implemented and provided to parents.

CARE AND/OR SUPERVISION: 14230 - CCLR s.51(1)(b) - A licensee must (b) provide to employees and parents a written statement of the licensee's policy on behavioural guidance.
Observation: The manager stated that parents have not been provided with the behavioral guidance policies.
Corrective Action(s): Ensure parents are provided with the behavioral guidance policies.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: Licensing observed medication ointment in the first aid kit, and the manager stated that this is administered to children if they get a scratch. There are no medication consents for this medication.
Corrective Action(s): Ensure a medication consent is in place for any medication administered.

PROGRAM: 18010 - CCLR s.44(1)(a) - A licensee must provide to children a comprehensive and coordinated program of indoor and outdoor activities that (a) is designed for the development and care of children.
Observation: Licensing observed that there were no opportunities for gross motor activities. Two children were seen climbing on the toy shelf.
Corrective Action(s): Please ensure a program of activities is provided that encourages all areas of development as outlined in Schedule G of the Child Care Licensing Regulation (CCLR)

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed attendance for three days. On Monday August 27th the Manager stated that there were eight children in attendance, however only four children were signed in on this day. On Tuesday Aug 28th the Manager stated that there were five children in care, however only two children were signed in. The LO stated to the Manage that the children must be signed in by the staff if the parents fail to do so. The Manager did not sign the children in.
Corrective Action(s): Please ensure that attendance is recorded upon arrival and departure. Corrected during the second inspection date.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Four childrens files were reviewed, two children were missing an emergency contact phone number.
Corrective Action(s): Please ensure emergency contact phone numbers are added to children's files.
Date to be Corrected: September 7th, 2018


Comments

Licensing Discussed:
Licensed space must be available to the children. The manager stated that she would make the whole area available when there are more than 4 children in care, which was observed by licensing (7 children in care) and this space was still not made available.
Licensing discussed the importance of hot kettles being emptied after use.
Licensing discussed the importance of staff being aware of children's records including minor allergies (manager was unaware of 1 child with a minor allergy).

Licensing reviewed this report with the licensee/manager. Licensing notes that the manager has Child Care Links and this was recommended as a resource to maintain compliance.
