Introduction

An unscheduled follow up inspection was conducted to assess contraventions noted on Routine Inspection #WBET-CSRQP9 dated June 13, 2023

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: A fridge in the infant/toddler program was 10c.
Corrective Action(s): Please ensure the fridge temperature is between 0-4c.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Files for three casual staff were reviewed. Site specific criminal record checks were not available in any file.
Corrective Action(s): Please provide a written plan stating how the Licensee will ensure site specific criminal record checks are available for all staff.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Files for three casual staff were reviewed. Evidence of references being checked was not available in any of the files.
Corrective Action(s): Please provide a written plan stating how evidence of reference checks will be available.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Files for three casual staff were reviewed. A copy of a certificates or other evidence of the person's training and skills was not available in one file.
Corrective Action(s): Please provide a written plan stating how the Licensee will ensure a copy of certification is available for all staff.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Files for three casual staff were reviewed. Immunization status was not available in two files.
Corrective Action(s): Please provided a written plan stating how the Licensee will ensure immunization status is available in all staff files.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Files for three causal staff were reviewed. A certificate for one staff had not been verified.
Corrective Action(s): Please provide a written plan stating how the Licensee will ensure all staff certificates have been verified.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: A care plan for one child does not include the course of action recommended by health care professionals for a child requiring additional support.
Corrective Action(s): Please ensure actions staff need to take are included in the care plan.

RECORDS AND REPORTING: 19230 - CCLR s.58(1)(c)(i) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (c) the resources to be made available to the child requiring extra support by the licensee, including (i) any adaptation of the community care facility necessary to ensure the child's safety or comfort.
Observation: A child’s care plan does not specify the medication required by the child.
Corrective Action(s): Please ensure that if a child requires medication, the medication is specified in the care plan.

Comments

At the inspection dated August 24, 2023 there were 31 children and six staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. This report was reviewed with the manager and a copy of this report will be emailed to the manager.
The following were discussed:
Unless there is a temporary retention approved by Licensing, a child must move to the Group Child Care (30 months-school age) on their third birthday.
Licensing does not require care plans to be written on specific forms. It it up to the family and the Licensee how the care plan is written.
Casual staff require screening before they start work.
Tracking the temperature of fridges on a daily basis to ensure they are between 0-4C
