Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP).
All care categories were inspected for compliance.

Contraventions

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The manager's name was not displayed in a prominent place in the community care facility. This is a repeat contravention.
Corrective Action(s): Please ensure to display in a prominent place in the community care facility both the licence, and the name of the manager.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Five staff files were reviewed, of those, one staff certification had expired. The staff said that they had submitted the renewal one month before but had not yet received it.
Corrective Action(s): Please ensure to display in a prominent place in the community care facility the certificate or a copy of the certificate.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection licensing observed:
-Damage to the wall where drywall was exposed in 6 small areas of play. Some areas were patched, and staff said they were planning of painting in the coming weeks.
-In one bathroom for children's use, the toilet paper roll was broken off the wall
Corrective Action(s): Please ensure to establish systems to ensure that a healthy and safe environment is provided at all times.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed 5 staff files, of those, one staff's file contained an expired criminal record check. Staff in the program said that the criminal record check had been completed however it was not available to review during the inspection.
Corrective Action(s): Please ensure to keep record of criminal record check for persons employed in the facility

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation (CORRECTED DURING INSPECTION): Licensing reviewed 20 children's files, of those two did not contain record of the child's gender.
Corrective Action(s): Please ensure to establish a system to ensure record showing gender of the child is documented.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: At licensing arrival the group child care program and the preschool program groups were combined, and playing outside. There was no record of children being signed in and out of each classroom. This is a repeat contravention.
Corrective Action(s): Please ensure to create and implement a system that reflects which program they are attending and the time of arrival and departure.
Date to be Corrected: Immediately and ongoing.


Comments

Summary of Inspection:
· During today’s inspection, there were 18 children, and 3 staff present.
· At this inspection, the above noted contraventions were identified. Licensee is required to submit a corrective action plan to address the contraventions.

The following was discussed:
· Care plans
· Emergency response plans
· Parent package, and the bulletin board indicated classes are operating on Saturday and Sunday. Staff said this was not happening. Licensing provided education around the changes in operation and parent agreements.
