Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Licensing observed two certificates of three were posted.
Corrective Action(s): Please ensure the staff and Manager's certificates are posted in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The following was observed inside and outside the facility:
-Multiple bibs were hanging closely together. This could cause a potential for cross contamination.
-Two gates were left open. This could cause a potential hazard. In discussion with the staff she stated this is checked when the children go outside to play. Licensing observed this gate was left open when the children went out to play.
-The garage door was accessible. Inside was a lawnmower, a can of paint and a freezer. This is a repeat contravention from inspection # CLAN-CFDTMC, #CLAN-C4WR7M and #CLAN-BAXVBY
-An extension cord for lights was hanging lowly from a tree to the deck. This may cause a potential hazard. This is a repeat contravention from inspection # CLAN-C4WR7M
-A bifold door lock was broken. Inside the cabinet were staff bags. In addition the bifold door could cause a pinching hazard.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times to the children in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following:
-Visible dirt was observed in the washroom behind the toilet. This is a repeat contravention from inspection #CLAN-CGJRBL, #CLAN-CFDTMC
Corrective Action(s): Please ensure the facility is clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: Licensing observed the following:
-Several areas of the lattice fencing were in disrepair. Rusty brackets were observed in the fence. Two large holes were observed in the fencing. As the facility is located next to an active construction site this could cause a potential hazard.
Corrective Action(s): Please ensure the outdoor play area is enclosed in a manner that ensures the children are safe from harm.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11180 - CCLR s.16(4)(a) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (a) suitable for the age and development of the children.
Observation: During the inspection a 2 wheel bike was observed. This is not developmentally appropriate for the children in care This is a repeat contravention from inspection #CLAN-C4WRZM.
Corrective Action(s): Please ensure to provide developmentally appropriate materials and equipment to the children in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: The following was observed at the inspection:
-A rust mark was observed in the floor of the washroom. Rust was observed dripping from a bolt on the toilet. This is a repeat contravention from inspection #CLAN-CGJRBL, #CLAN-CFDTMC. Rust can cause a potential health hazard.
-Rust was observed on a barbell in outdoor play area. Rust can cause a potential health hazard.
- Ice melt was observed in a container at the front entrance to the facility.
Corrective Action(s): Please ensure children do not have access to any object or substance that may be hazardous to their health and safety.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: The Manager's record was observed during the inspection. A site specific criminal record check was not observed in the record.
Corrective Action(s): Please ensure the Manager's record is complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: The Manager's record was observed during the inspection. A validation for the Manager's ECE certificate was not present.
Corrective Action(s): Please ensure the Manager's record is complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Licensing observed that two children's records did not have a name or number of a medical practitioner.
Corrective Action(s): Please ensure children's records are complete.

Comments

At the inspection dated May 3, 2023 there were 4 children, 2 staff and the Manager arrived during the inspection. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by May 16, 2023 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Manager.

The following was discussed:
-The reportable incident reporting procedure. Forms and the bulletin were given to the Manager
-The current cleaning protocols that are in place
-Preventing lead in the water
-The outdoor play space was observed. Another inspection will be completed at a later date to confirm the measurements of the outdoor play space.
-Ensuring the previous minor log book is available for review.
-The maintenance plan for the facility.
-Placing a sign on the trampoline restricting access, as it is not age appropriate for children in care.
