Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11430 - DLSOP Safe Play Space (ground surfacing [b8]) - [bullet 8] Any protective surfacing used must be checked regularly to ensure the depth and adequacy of the material.
Observation: On review of the outdoor play areas, Licensing observed that the resilient surfacing of pea gravel in the North playground area was only 2" deep in some areas where the equipment was 5' high.
Corrective Action(s): Please ensure that these fall areas are regularly checked for adequate depth of resilient surfacing to prevent injury during a fall. Please see DLSOP for Safe Play areas. (Provided at inspection)

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation (CORRECTED DURING INSPECTION): On review of a random selection of staff files, Licensing observed that 1 staff on site today did not have any clearance on file from the Criminal Records Review Branch (CRRP), 1 staff has RCMP clearance and a 3rd staff has CRRP clearance which is not site specific. On Day 2 Manager stated that 2 were in process and showed documentation that attests to that.
Corrective Action(s): Staff without CRRP clearance must not be employed. Screening must be in place prior to employment. Please provide a copy of both staff CRC once received.
Date to be Corrected: Immediately

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation (CORRECTED DURING INSPECTION): On review of a selection of staff files, Licensing observed that 3 staff were missing character references. These staff were on site today.
2nd day visit - Manager provided evidence of character references for all but 1 staff
Corrective Action(s): Please ensure all employees are properly screened prior to employment

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation (CORRECTED DURING INSPECTION): On review of a random selection of staff files, Licensing observed that 1 staff on site today was missing a resume. Provided on Day 2
Corrective Action(s): Please ensure staff are fully screened prior to employment to ensure they have the necessary knowledge and experience to work with children.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: On review of a random selection of staff files, Licensing observed that 2 staff were missing certificates of qualification. 1 staff was a second staff in the Group Child Care 30 months to school age program and the other staff was a floating staff working in all 3 programs. Both staff were on site today.
Corrective Action(s): These staff must not be employed in any position unless certified to do so or part of an approved staffing plan through exemption. Please provide a compliance plan to Licensing by the date below.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: On review of a random selection of staff files, Licensing observed that 2 staff were missing immunization status. Both of these staff were on site today.
Corrective Action(s): Please ensure all employees are fully screened prior to employment.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: On reveiw of a random selection of staff files, Licensing observed that none of the staff certificates have been validated through the ECE Registry.
Corrective Action(s): Please ensure that all certified staff credentials are validated throught the ECE Registry.

POLICIES AND PROCEDURES: 13110 - DLSOP Active Play - [The Licensee must develop and implement an Active Play Policy to engage children in daily active play, consisting of un-facilitated play and facilitated games and activities.] This policy should also be shared with parents/families.
Observation: Licensing observed the policy to be created but not added to the staff and parent handbooks.
Corrective Action(s): Manager will give copies to parents

POLICIES AND PROCEDURES: 13130 - DLSOP Active Play - [The Licensee must develop and implement a Screen Use Policy to guide employees in the use of screen time activities.] This policy should also be shared with parents/families.
Observation: Licensing observed that policy has been created but not added to the parent or staff handbook..
Corrective Action(s): manager will give copies out to parents

CARE AND/OR SUPERVISION: 14170 - CCLR s.43 - A licensee must, in addition to care, provide children with opportunities for social, emotional, physical and intellectual growth.
Observation: During inspection, Licensing observed 3 children from the Group Child Care under 36 month program confined in strollers during nap time. These children were not sleeping and were being walked up and down the facility hallway at intervals. In discussion with room supervisor, it was stated that this is only for a few minutes whilst the other children are being helped waking up. Licensing actually observed this to take place for over half an hour.
Corrective Action(s): Please ensure that all children have access to quiet program activities during times when they may not require a nap time rather than being limited through confinement in a hallway.

CARE AND/OR SUPERVISION: 14220 - CCLR s.51(1)(a) - A licensee must (a) ensure that behavioural guidance is appropriate to the age and development of the child who is receiving the guidance.
Observation: Licensing observed a staff using an inappropriate tone when giving instruction to a child. Child did not understand what was required of them and staff did not give any eye contact during direction or guide the child in an appropriate way. Discussed with the Manager on Day 2.
Corrective Action(s): Please ensure staff use appropriate guidance techniques with each child to meet their individual needs.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed diaper changing in the Group Child Care under 36 months porgram and witnessed a staff changing a selection of children's diapers and not washing their own hands between diaper changes, nor washing any of the children's hands after changing. Practice is to have the child take the dirty diaper and put into the covered container.
Corrective Action(s): Handwashing after handling dirty diapers should always take place to guide children in practicing the rules of health and hygiene. Please submit a policy response to Licensing

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was the Manager and 9 staff members with 35 children throughout the 3 programs.
There were some concerns over staffing qualifications (see above) but ratio of staff to children was appropriate.
There is currently an approved staffing plan in place for the Group Child Care under 36 months program.
Programming is posted and available for parent review in the facility hallways on notice boards.

Licensing observed Staff engaged with children in the Group Child Care under 36 month program as children were having diaper changes and getting ready for outdoor play.
In the Group Child Care 30 months to school age programs, Licensing observed staff gently waking children and getting ready for snack time. One program was having a small circle time as some children were being dismissed for the day.
Licensing observed the children making their own choices as to what materials they wished to choose in the Montessori programs and washing hands for snack times.

Discussions with the Manager/Licensee/Staff:-
- Licensing reviewed policies with the Manager and reviewed outdoor renovations with the Licensee on Day 1.
- Licensing provided information regarding the change in regulation for the sharing of outdoor space for same service types if appropriate in size. This allows the 2 groups of Infant/Toddlers to use the same outdoor space together, opening up the 2nd play space.
- Licensing recommends an audit of staff files to ensure completion prior to employment.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection will be conducted due to the number and nature of the contraventions.

This inspection report was written off site on Day 1 and reviewed with the Manager on Day 2.
