Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

Child Records and reporting

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

At the time of this inspection all areas inspected were found to be in compliance with exception of those noted below.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10060 - CCLR s.11(3) - When advertising or otherwise offering services to the public, a licensee must identify the care program being offered.
Observation: Licensing reviewed registration information which shows that the facility operate 'preschool' programs when in fact are also licensed for Group child care 30 months to school age as well as Preschool. This is not advertised in any of the literature.
Corrective Action(s): Please ensure advertising relates to the programs offered. Please provide a compliance plan as to how this will be addressed.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: On review of the outside play space, Licensing observed in the Group child care under 36 month play space that there were tree root/sleepers protruding from the grass area which were a tripping concern for the younger children.
Licensing also observed 2 play structures that were positioned close to the building at the climbing parts which if a child slipped while climbing the structure, they could injure themselves on the building framework.
Corrective Action(s): Please ensure that all outdoor playspaces are safe and free from harm. Manager repositioned the climbers during inspection.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: On review of 5 staff files, Licensing observed that two staff were missing immunization status.
Corrective Action(s): Manager corrected one file and staff will correct theirs by the end of day today

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: On review of 17 children's files, Licensing observed that one was missing immunization status.
Corrective Action(s): Please ensure all children's records are complete at the time of registration

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: On review of 17 children's records, Licensing observed that 1 was missing a Doctor's information.
Corrective Action(s): Please ensure that records are complete on registration.

Comments

At todays inspection the Manager was on site to assist Licensing.
There were 6 other staff on site throughout the 3 program rooms operating.

Licensing observed children during nap time in all programs with some children in quiet free play activities. Outdoor play is on a daily basis as stated by staff and is scheduled for the programs sharing space. Children were observed to be outside during inspection.

Licensing discussed with the Manager:
- Care plans and ensuring that each staff is fully aware of the location of all documentation. A care plan in place today needs further information to inform staff of appropriate care and guidance in case of an emergency.
- Two staff have Occupational first aid certificates which do not meet the requirements of legislation. Manager states that these staff never work alone.
- Discussed minor incident records
- Discussed an amendment to the current licence and the advertising of the programs.

Staff were observed interacting with the children using appropriate language and guidance.
Children's needs were met on an individual basis.

No other concerns identified at today's inspection.
