Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection the following was observed:
-4 electrical outlets did not have outlet covers
-A large heavy speaker was on top of a rolling cart. This was not secured and may have the potential to fall over.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: Licensing observed there are two emergency exits in the facility. Both exits were partially blocked.
Corrective Action(s): Please ensure emergency exits are not blocked to ensure a safe exit in case of an emergency.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: A door to the closet was easy to open. On the floor were various chemicals such as bleach, Borax and laundry detergent. This was corrected during the inspection.
Corrective Action(s): Please ensure children do not have access to any objects or chemicals that may be hazardous to their health and safety.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: Licensing measured the water temperature. The water temperature in one of the sinks measured 49.9 degrees Celsius. Please provide active supervision in this area until this is fixed
Corrective Action(s): Please ensure the hot water is heated to no more than 49 degrees Celsius to meet the legislative requirement.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: One staff record and the Managers record were reviewed. The staff record was missing a site specific Criminal record check (CRC)
Corrective Action(s): Please ensure staff records contain site specific CRC's

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one employee.
Corrective Action(s): Please ensure the staff records are complete.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: Licensing observed the staff record and Manager record. First aid certificates were not on file. In discussion with the Manager she stated she and the current staff at the facility did not have first aid certificates.
Corrective Action(s): Please ensure children have immediate access to an employee who holds a valid first aid certificate

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed the record of fire drills and the annual emergency drill. The last recorded fire drill was in February 2022. The annual emergency drill was not recorded. In discussion with the Manager she stated these drills were practiced but they were not recorded.
Corrective Action(s): Please ensure to record fire drills and the annual emergency drill.

NUTRITION AND FOOD SERVICES: 17120 - CCLR s.48(6) - A licensee must make available to parents information on the food and drink given to children.
Observation: During the inspection Licensing observed a snack menu was not posted in the facility.
Corrective Action(s): Please ensure to make available information to the parents on the food and drink given to the children.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Four children's records were reviewed. Four children's records were missing their MSP number and one record was missing immunization information. Missing immunization is a repeat contravention from inspection #CLAN-CCTUJN and #CLAN-CC3TX3
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Four children's records were reviewed. Four children's records were missing a date of enrollment. This is a repeat contravention from inspection #CLAN-CCTUJN and #CLAN-CC3TX3
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: During the inspection the attendance records were reviewed. Several departure times were missing for the month of February.
Corrective Action(s): Please ensure attendance records are complete.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Four children's records were reviewed. Four children's records were missing a photograph.
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: Four children's records were reviewed. Four children's records were missing consent to call a medical practitioner or ambulance in case of accident or illness.
Corrective Action(s): Please ensure children's records are complete.

Comments

At the inspection dated February 22, 2023 there were 15 children, 1 staff, and the Manager was present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by March 8, 2023 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Manager.

The following was discussed:
-The reportable incident reporting procedure.
-The current cleaning protocols that are in place
