Introduction

A scheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance. A covid-19 risk screening was completed prior to completing the routine inspection.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
-carpet in poor condition and unraveling at the front door posing a tripping hazard.
-items stored near the front door including a child's picnic table located on its side.
-hand sanitizer located in the children's activity area accessible to children.
-Drywall along the window sill exposed and chipping.
Corrective Action(s): Ensure that a healthy and safe environment is provided by addressing the concerns above.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 1 of 3 staff files reviewed did not contain a criminal record check addressed to the facility. A criminal record was on file for another facility.
Corrective Action(s): Ensure that each employee has a criminal record check addressed to the facility.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: 1 of 3 staff files reviewed did not contain evidence the certificate was verified by the ECE registry
Corrective Action(s): Ensure each educator or assistant certificate is verified by the system established by the ECE registry.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: No record of an emergency plan being implemented within the last year.
Corrective Action(s): Ensure that an emergency plan is implemented once per year.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: 4 children under the age of 36 months were present during the inspection.
Corrective Action(s): Ensure that no more children than permitted in schedule E are present.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Children's hand towels were observed touching in the children's washroom.
Corrective Action(s): Ensure that towels are single use or not touching another child's towels.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: 5 medications were observed with no direction to staff on how and when to give the medication.
Corrective Action(s): Ensure that medications are administered in the amount and times specified by the parent.

MEDICATION: 16030 - CCLR s.53(2)(a) - A licensee must ensure that a child's medication is not accessible to any child, except that a child may have access to his or her own medication if (a) the child's parent has instructed the licensee to permit this.
Observation: Licensing observed 5 medications located inside a child's backpack accessible to children.
Corrective Action(s): Ensure medications are not accessible to children in care.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: A child requiring a care plan did not have one developed.
Corrective Action(s): Ensure that children requiring a care plan have one developed in consultation with the parent.

Comments

Summary of Inspection
At the inspection dated September 16, 2020 there were 8 children and 2 staff present. At this inspection the above contraventions were identified. The manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the information. As part of this Routine Inspection a Facility Risk Assessment Tool and a Covid-19 Infection control assessment were completed and a copy was provided. This inspection and the risk assessment were written off site and a copy was emailed to the facility.
The following education/recommendations were provided:
· Increased sanitization procedures
· Facility cleaning supplies and products
· COVID-19 prevention strategies were reviewed and discussed.
