Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance with the exception of the emergency supplies, and the water temperature. This will be completed at another inspection.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The following was obseved during the inspection:
-Children's wash cloths were hung in the washroom. The washcloths were hanging close together and were touching. This could have the potential for cross contamination.
-Licensing observed a staff changing the children's diapers. Licensing observed the staff using the same gloves for multiple diaper changes and the staff did not wash her hands between or after diaper changes. In addition the staff did not disinfect the changing surface with an approved disinfectant between changing children's diapers.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following inside the facility:
-medication on the counter within reach of the children. This was corrected during the inspection
-a speaker with a long cord was plugged into an outlet in the washroom. The speaker was sitting on the counter top next to the sink.
Corrective Action(s): Please ensure children do not have access to any objects or substances that may be hazardous to their health and safety.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Licensing arrived at the inspection at 10:15 am. The Licensee and another staff were present at the facility. The Licensee is an Infant Toddler Educator. In discussion with the Licensee she stated that the staff was in the process of completing her Early Childhood Educator Certificate (ECEA) and another staff would arrive shortly. No records were present at the facility for the staff. The legislative requirement is one Infant Toddler Educator for 4 children and one Early Childhood Educator (ECE) for 5-8 children to be present all times. An ECEA staff can temporarily replace an ECE for up to 30 days. As the staff was in the process of obtaining her ECEA certificate this did not meet the legislative requirement. The serious risk to children in care was discussed with the Licensee. Another staff who has their ECE arrived 15 minutes into the inspection.
Corrective Action(s): Please ensure the ratio of employees to children attending the facility is no less than the legislative requirement outlined in Schedule E in the Child Care Licensing Regulation.

HYGIENE AND COMMUNICABLE DISEASE: 15050 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: During the inspection Licensing observed the staff changing diapers on a change table in the play area. In discussion with the Licensee she states she changes the younger children on the change table to ensure they have a safe place and don't fall. The Licensees proposed plan was to change children on a mat on the floor in the washroom as this would preserve the child's dignity and ensure the Licensee has access to a sink beside the diaper changing area as required in the legislation.
Corrective Action(s): Please ensure the children's dignity is maintained by changing the children's diapers in the washroom and place the diapering area next to a sink to comply with the legislation.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: The attendance record was reviewed. One child was not signed in on the attendance record.
Corrective Action(s): Please ensure that the children's attendance records are complete.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: During the inspection Licensing reviewed the staff records and the children's records. One staff record and one child's record was not present. Both the staff and the child were in attendance. In discussion with the Licensee she stated she had reviewed all of the staff's information but did not have a copy of the information on site. The child's record was brought to the daycare by the parent during the inspection.
Corrective Action(s): Please ensure staff records and children's records are on site when staff and children are in attendance.

Comments

At the inspection dated November 7, 2022 there were 8 children, 1 staff and the Manager was present. During the inspection another staff member arrived. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by November 8, 2022 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Licensee.

The following education/recommendations were provided:
-The reportable incident reporting procedure. The Reportable incident bulletin was provided
-The current cleaning protocols that are in place
-Checking references and documenting responses

The inspection findings were reviewed with the Manager at the inspection and in a phone call after the inspection. A copy of these documents were sent to the Licensee. If you have any questions regarding this report please contact me.
