Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance with the exception of the policies and procedures. These will be reviewed at the next inspection.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following:
-a hole in the wall at the children's level where drywall was exposed.
-a bookshelf was damaged
-marks on the wall missing paint where a garbage can was placed
-wear marks on shelves and a table where paint and sealant was removed could harbour bacteria and make it difficult to clean.
Corrective Action(s): Please ensure the facility and equipment are in good repair

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following during the inspection:
- in several classrooms staff purses were within easy reach of the children. Locked cabinets have been provided to the staff but some of the staff bags were in unlocked cabinets while others were at the children's level in the classroom. This is a repeat contravention from inspection # CLAN-BTYVSW and #CLAN-BJ5PNW
-An ipad was proped against a narrow window ledge. Children were sitting in a circle directly below the ipad.
-Several cords and two stereo cords were not secured. This is a repeat contravention from inspection # CLAN-BTYVSW and #CLAN-BJ5PNW
-A cubby in the classroom was not secured. This could present a potential tipping hazard
-Paint was under the sink
-5 chairs were stacked over 4. 5 feet tall. This was observed int he infant room. The could present a potential falling hazard
-multiple bottles of sunblock were on a low shelf. This was accessible to children.
-A string of Christmas lights had a loose cord. This was within easy reach of the children
-several electrical outlets were missing plug covers including a power bar with multiple outlets. This is a repeat contravention from inspection #CLAN-BJ5PNW.
Corrective Action(s): Please ensure children do not have access to any objects or substances that are harmful to their health and safety.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Five staff records were reviewed. One staff record was missing character references. This is a repeat contravention from inspection #CLAN-BJ5PNW.
Corrective Action(s): Please ensure staff records are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Five staff records were reviewed. One staff record was missing a verification from the ECE Registry. This is a repeat contravention from inspection #KSEY-B8JRK6.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed that a record of a fire drill being completed was not recorded for the month of October. In discussion the Manager stated it was completed but not recorded. This is a repeat contravention from inspection #KSEY-B8JRK6
Corrective Action(s): Please ensure fire drills are recorded to comply with the legislation

CARE AND/OR SUPERVISION: 14360 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: During the inspection licensing observed two children being changed by two teachers in the classroom. The children were changed out of their clothes and into a CEFA uniform. One child's bare chest was exposed to the children, teachers, the Manager and the Licensing Officer who were present in the room.
Corrective Action(s): Please ensure to change the children in the washroom to ensure you promote and preserve the child's privacy and dignity.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: No care plan available for a child requiring extra support.
Corrective Action(s): Please ensure a care plan is created for each child that requires medication in an emergency.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: The care plan was not reviewed annually with the parent or any person requested to by the parent.
Corrective Action(s): Please ensure care plans are reviewed and dated once per year.

Comments

At the inspection dated December 16, 2021 there were 64 children, 13 staff, and the Manager was present at the end of the inspection. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by January 6, 2022 , unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Manager.

The following education/recommendations were provided:

-The reportable incident reporting procedure and form.
-The current COVID-19 protocols that are in place
-keeping children's water bottles separated
-moving large climbers and structures away from the fence and to have a 6 foot fall distance between structures
- The Manager has created a system for children's records. The Licensing officer acknowledges the hard work that has gone into creating a system for assessing the children's records.

The inspection findings were reviewed with the Manager during the inspection. Due to the COVID-19 pandemic the inspection report and the risk assessment were completed at the Burnaby FHA office.
