Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP).
All areas of the facility were reviewed for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Three staff files were reviewed and a record of a Criminal Record Check (CRC) was missing for one staff. Both the staff and the Manager stated this staff does not work alone. The staff also stated an application has been submitted to request to have result shared with the current facility and also a RCMP check is also complete, however there were no copies of the checks on site.
Corrective Action(s): Please ensure all staff records are complete, including a current CRC from the Criminal Record Review Program for staff prior to employment. Please ensure a Health and Safety Plan is in place until a CRC is received from the Criminal Record Review Program. Please note this is a repeat contravention.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Proof of validation of ECE Certificates is missing for 2 staff.
Corrective Action(s): As per discussion, please ensure all staff documentation is completed prior to employment. Please note this is a repeat contravention.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: Twelve registration records were reviewed and immunization status is missing for 2 children in the Group Child Care (school age) Program. Photos are attached to the emergency consent cards, and all consents are complete, however photos or digital image is missing for 5 children. Records indicate photos have been requested but noy yet received.
Corrective Action(s): Please ensure all records are completed prior to children attending.

Comments

Summary of inspection:
At today’s inspection there were 9 children and at start of inspection there were 2 staff present and a third staff arrived within a few minutes, in the Group Child Care (30 months to school age) Program.
The Group Child care (school age) program was not operating at time of inspection, however the program space and records for the program were reviewed.
In total 22 children are currently enrolled.
At this inspection the above noted contraventions were identified.
Licensee is required to submit a corrective action plan to Licensing by the date below
Licensing will review and monitor the corrective action plan.
As part of this Routine Inspection a Facility Risk Assessment Tool was completed and a copy was provided.

The following education/recommendations were provided through discussion:
- Promoting Active Play in the program
- Temporary Placement/Exemptions
- Active Supervision
- Reportable Incident reporting to Duty line: #604 587 3936 for emergencies if area Licensing Officer can’t be contacted.
- Bill 5 awareness – Facility has been receiving Licensing Officer’s emails.

An exemption application has been received for the Group Child Care (30 months to school age) program and was reviewed at time of inspection and additional information is required prior to approval.
A follow up inspection will be completed to observe the Group Child Care (school age) program and to monitor compliance after receiving written response to the contraventions.
