Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Contraventions
Previous Inspection - Contraventions observed on FIR #SWAR-AVKTV2 have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation (CORRECTED DURING INSPECTION): The manager's name was not posted for families.
Corrective Action(s): Ensure the name of the manager is displayed in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The staff have personal items spread out in various spaces within the environment; including purses and cups filled with coffee and tea. These items are accessible to the children in care.
Corrective Action(s): Ensure that a safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): There are various diaper creams accessible to children in the washroom the children use. Bleach/water solutions are mixed regularly however these bottles are not labelled to identify the contents.
Corrective Action(s): Ensure that hazardous substances are not accessible to children.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Four staff files were reviewed. One staff member's criminal record check expired in December 2018. The manager states she has reapplied.
Corrective Action(s): Ensure all staff files are complete.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: The staff confirm they did not practice implementing the emergency plan in 2018.
Corrective Action(s): Ensure staff are prepared in the case of an emergency evacuation by practicing the emergency plan at least once each year.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: Four staff files were reviewed. One employee does not hold a valid first aid certificate.
Corrective Action(s): Ensure staff files are complete.

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: As documented in the minor incident log book, on December 19, 2018 the facility closed mid day due to a power outage. As identified in schedule H of the child care licensing regulations this is a reportable incident however it was not reported.
Corrective Action(s): Ensure all reportable incidents are reported to Licensing within a 24 hour period.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Six children's files were reviewed. One file did not include an enrollment date.
Corrective Action(s): Ensure all children's files are complete.

Comments

Summary of inspection
At this inspection there were 20 children and 6 staff present. The manager was also on site during this inspection. At this inspection the above noted contraventions were identified. The facility is required to take corrective action to bring the facility into compliance and provide a written response to Licensing by February 11, 2019. The Licensing Officer will email the manager information regarding first aid supplies. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
