Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for two employees.

This item was contravened on Oct. 16, 2020 on routine inspection report #MZIN-BUFS65.
Corrective Action(s): Ensure that the work history (resume) of staff are included on file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Licensing checked staff files and observed that 1 staff did not have their certificate validation on file.
Corrective Action(s): Ensure that the staff files have the certificate validation on file.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed that the fire extinguishers were supposed to be serviced on 2021/10/20 according to the tag attached.
Corrective Action(s): Ensure that the fire extinguishers are serviced and ready to use in case of an emergency.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing checked the children's files and observed that 7 children did not have their immunization record status on file.

This item was contravened on Oct. 16, 2020 on routine inspection report #MZIN-BUFS65.
Corrective Action(s): Ensure that the immunization record status for all children are included on file.

Comments

The manager was on-site and assisted with the inspection. At this inspection, the above noted contraventions were identified. Actions required by the licensee includes a written response. The contraventions noted in this report were reviewed with the facility during the inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations/discussions were provided:
- Reportable Incident procedures, which is to be reported within 24 hours. Child care staff are asked to call their Licensing Officer to make the report. If the Licensing Officer is unavailable, please call the Duty Line Licensing Officer. This telephone number is staffed during regular business hours.
- As explained by the manager, the facility currently has one minor log book for all classrooms. Continue to document minor incidents using the incident log bound book, and take note of any illness and unexpected events involving children not requiring medical attention, and that are not reportable incidents as described in Schedule H and staff to continue to initial and date after each documentation.
- Continue to regularly check the outdoor play area before children use the space
- Practicum student file requirements
- Certificate validation process
- Regularly check and update staff files (CRC, immunization status, professional certificates, first aid, references, resume, validation)
- Continue to clean and sanitize the facility including toys and equipment
- Check the expiry date of items in the emergency supplies kit
- Remove all items with an NPN / DIN # in the first aid kit, as parent’s permission is required before using these items on children. Mild soap and water can be used to clean any minor cuts or scrapes.
