Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

The following areas were reviewed:
Licensing
Physical Facility
Staffing
Policies and Procedures
Care and supervision/Hygiene and medication
Nutrition
Program
Child Records and reporting

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A review of 4 staff files indicated record of completing reference checks is missing for 2 staff.
Corrective Action(s): As discussed, please ensure a record is kept of reference check as per CCLR.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Resume is missing for one staff. Manager stated it was obtained and may be misfiled.
Corrective Action(s): As per CCLR, please ensure all staff documentation ic complete for staff prior to employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Record of immunization status is missing for one staff.
Corrective Action(s): Please ensure all staff records are complete as per CCLR. It is noted this is a repeat violation.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: A copy of the ECE Certificate is posted for a staff but proof of validation is not available.
Corrective Action(s): Please ensure all staff records are complete as per requirements. Process for validation was reviewed with the Manager.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Staff plan for the Preschool does not meet requirements as the staff plan includes a staff who is not qualified as an ECE Assistant. The staff plan has an ECE qualified staff and a Responsible Adult staff for the Preschool program. Staff plan for the Group Child Care (school age) program meets requirements.
Corrective Action(s): As per discussion, please ensure staff plan meets requirements or an exemption approval has been obtained.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Twelve registration records for children were reviewed and all were complete with the exception of missing the immunization status for one child.
Corrective Action(s): Please complete as per requirements.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above.
The Manager was on site along with one staff and 13 children in care in the Preschool Program.
Discussions took place with the Manager regarding the following:
- Active supervision
- Reportable Incident (RI) process
- Lead in drinking water, running taps to flush pipes
- Staff records
- Exemption process

There is currently no exemption/temporary placement.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection may be conducted due to the number and nature of the contraventions.
