Introduction

An unscheduled follow up inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All identified non-compliance at the last routine inspection were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The following was observed:
-paint chipping on the walls exposing drywall
-the toilet in the infant classroom was not clean.
Corrective Action(s): Ensure a healthy and safe environment while children are in care. Please provide a written plan on how you have addressed the contravention.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The couches at the front are visibly dirty. The Licensee said he will have them washed.
Corrective Action(s): Ensure that the furniture is clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: On the south west corner of the playground there is a gap between the wall and the chain link fence about a foot wide. Currently there are logs, broken planters and brambles located in this gap. There is a potential for a child to climb between the wall and fence. This is not on the site plan.
Corrective Action(s): Ensure that the play area is enclosed in a manner that is suitable to the age and development of the children. Please provide an updated site plan of the outdoor play area.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: cleaning products were observed in an unlocked cupboard in the hallway kitchen.
Corrective Action(s): Ensure that cleaning products are unavailable to children.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 2 employees do not have criminal record checks addressed to the facility. It was discussed that the criminal record check must be addressed to the facility.
Corrective Action(s): Ensure that each employee has a criminal record check addressed to the facility.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: The facility does not have an infant toddler educator to work in both classrooms.
Corrective Action(s): Ensure that the ratio of employees to children is no less than that permitted in schedule E.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Licensing observed the following:
-The nap bedding in room 3 was touching each other.
-Toys were located next to the toilets in the infant toddler room.
Corrective Action(s): Ensure that bedding is not touching each other. Ensure that toys are sanitized and stored appropriately.

Comments

At this inspection the above noted contraventions were identified. The Manager will bring the facility into compliance and provide a written response to the Licensing Officer by June 14, 2021. The Licensing Officer will review the response.
