Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The following was observed:
- the landscape fabric in the 3-5 playground is exposed and poses a tripping hazard
-a table that folds out of the wall in the infant program is breaking and disconnecting from the wall
-both folding tables in the infant room are missing the washable cover on the table top leaving exposed raw wood that is unable to be sanitized.
-the baseboard in the kitchen area next to a child's table in the infant program is coming off the wall
-there are many areas of paint chips and exposed drywall throughout the facility in both programs
-the plate around the plug is missing in the infant nap room located next to a nap mat.
-a pillar located in the main play area of the 3-5 program is cracked from ceiling to floor leaving exposed drywall and the wood beam.
Photographs were taken and will be provided to the Licensee.
Corrective Action(s): Ensure that a healthy and safe environment is provided at all times.
provide your plan on how and when you will address the above information.
Please provide Licensing with written confirmation that the beam that is cracked is posing a health and safety concern to the children.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11080 - CCLR s.15(1)(a) - A licensee must supply equipment, furniture and supplies that are (a) of sturdy and safe construction, easy to clean and free from hazards.
Observation: Two of 5 play pens located in the infant toddler nap area were broken and the sides unable to be secured in an upright position.
Corrective Action(s): Ensure that the nap equipment is sturdy, safe and free from hazards

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Two early childhood educators certificates were not verified by the system maintained by the early childhood educator registry.
Corrective Action(s): Ensure that each certificate is verified.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The Manager said they completed a fire drill in July and an earthquake drill in the last year. There was no written record of compliance
Corrective Action(s): Ensure that a record respecting compliance is maintained.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: single use towels were not available for children to use to dry their hands
Corrective Action(s): Ensure that single use towels are available for children's use.

RECORDS AND REPORTING: 19180 - CCLR s.57(2)(k) - A licensee must keep, for each child, a record showing the following information: (k) the date on which the child stops attending the community care facility.
Observation: There were more than 20 children's files that did not contain the date when the child stops attending.
Corrective Action(s): Ensure that the children's records include the date when the child stops attending

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Two care plans were not reviewed annually with the parent or any person requested to by the parent.
Corrective Action(s): Ensure that each care plan is reviewed annually.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: 10 children's files were unavailable for review. The Manager was unaware of where the files were located and said they may be in the other facility.
Corrective Action(s): Ensure that each child's file is kept in a single place in the community care facility.

Comments

Summary of Inspection
At the inspection dated August 2, 2022 there were 16 children and 4 staff present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and submit a written response to the Licensing Officer by August 17, 2022. The Licensing Office will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
· Care Plans
· Cleaning Schedules
· Active Supervision
· Create and submit a playground schedule
· Ensure medication is labeled on the permission form
· Lead in the Water
