Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: The temperature of three fridges was measured. All fridges had temperatures of above 4c. Fluorescent light bulbs were exposed above the loft in the Group Child Care (under 36 months) program. This poses a risk to children if the light bulb shatters.
Corrective Action(s): Please ensure the temperature of fridges is between 0-4c and that fluorescent light bulbs are not exposed.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: A counter top in one of the Group Child Care (Under 36 Months) program has chipped edges.
Corrective Action(s): Please ensure the counter top is in good repair.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A criminal record check for one staff person had not been obtained through the CRC Sharing Program.
Corrective Action(s): Please ensure a valid CRC is available for all staff before they start work.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A resume was not available for one staff.
Corrective Action(s): Please ensure a resume is available for all staff.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one staff.
Corrective Action(s): Please ensure immunization status is not available for all staff.

STAFFING: 12280 - CCLR s.34(4)(a) - Despite this section, during the half hour before a care program begins and the half hour after a care program ends, a licensee may permit children who would otherwise be grouped in different care programs, and who are arriving at or leaving the community care facility, to be grouped together and supervised other than as required under Schedule E if (a) the care program is described as Multi-Age Child Care, Group Child Care (Under 36 Months), Group Child Care (30 Months to School Age) or Group Child Care (School Age).
Observation (CORRECTED DURING INSPECTION): On review of time in/out records, Licensing determined that the Group Child Care (Under 36 Months) and the Group Child Care (30 Months to School Age) are mixed for up to 45 minutes at the beginning of the day.
Corrective Action(s): Please ensure groups are not mixed for more than 30 minutes. To address this contravention the Licensee Contacted stated a staff person will start their shift fifteen minutes earlier.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: There are not enough emergency supplies for all children for up to 72 hours.
Corrective Action(s): Please ensure there are enough supplies available for all children.

MEDICATION: 16020 - CCLR s.53(1)(b) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (b) readily accessible to employees.
Observation: During this inspection staff were going outside without taking medication required by one child.
Corrective Action(s): Please ensure all medications are readily accessible.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Children in room 36 & room 37 (Group Child Care (under 36 months) ) are being signed in on one sheet making it difficult to know how many children are present in each room.
Corrective Action(s): To accurately show attendance, please ensure each room has its own time in/out sheet.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: One care plan was not reviewed annually with the parent or any person requested to by the parent.
Corrective Action(s): Please ensure all care plans are reviewed a minimum of once every twelve months.

RECORDS AND REPORTING: 19380 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: An expired Epi Pen was available for one child and medication named in a care plan was not available for another child.
Corrective Action(s): Please ensure that all medications listed in a care plan are available and have a current expiry date.

Comments

Summary of Inspection
At the inspection dated July 18, 2022 there were 28 children and six staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the Licensee Contact and written off site. A copy of this report will be emailed to the Licensee Contact.
The following education was provided:
Bottled water designated for hand washing/flushing toilets in the case of an emergency needs to be labelled indicating its use.
When cleaning table surfaces wash the surface with a soapy detergent then apply the bleach/water solution and let the surface air dry.
If staff records are stored on an electronic device that is not always at the facility (eg cell phone), a system needs to be in place so that the records are available for inspection .
