Introduction

An unscheduled routine was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). Evidence for this report was based on the licensing officer’s observations, review of the facility records, and information provided by the facility staff at the time of inspection.
The following areas were reviewed:

· Care and Supervision · Records and Reporting

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection, and a 3 year ‘historical’ review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #SCLY-ARLUB6 have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: -The space on top of the cupboards is used as a storage area, and some items were close to the edge with the potential to fall, posing risk of injury to children should they fall.
Corrective Action(s): Please ensure storage systems are addressed to reduce risk of injury

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: A knife was observed in a bin on the counter, accessible to children
Corrective Action(s): Please ensure children do not have access to hazardous objects that may pose a risk to their health and safety

POLICIES AND PROCEDURES: 13071 - CCLR s.56(2) - A licensee must ensure that the policies and procedures referred to in subsection (1) are implemented by employees.
Observation: Nutrition policy includes that the facility will not provide food services by warming or cooking food items for children. Records indicate that food preparation and service does occur and when discussed with staff, it was confirmed that cooking does occur occasionally.
Corrective Action(s): Please ensure the nutrition policy is consistent with your practices. If food services which includes cooking and offering food that is not pre-packaged occurs, please provide your plan for review

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation: The program operates within 2 classrooms that are not within close proximity and out of the sight lines of the staff. Children arrive at one location and the manager described that the transfer to the other location includes older children grade 3 and up escorting younger children to the 2nd classroom, which was observed today.
Corrective Action(s): Please provide your plan to ensure children are supervised during times of transfer from one classroom to the other

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: Observed children participating in snack, however only one child was observed washing their hands
Corrective Action(s): Please ensure children practice the rules of health and hygiene

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation (CORRECTED DURING INSPECTION): A form was observed to be filled out by staff when they provide medication to one child. The form indicated that there was a dose increase, but no documentation of this increase was available. The manager confirmed that the increase was communicated verbally, but it was not recorded. The contravention was corrrected during inspection and the noted changes were documented
Corrective Action(s): Please ensure any change in medication is documented and shared with all staff

PROGRAM: 18060 - CCLR s.44(3)(4)(5) - A licensee, other than a licensee providing a care program described as Occasional Child Care, must provide each child with daily outdoor play periods unless weather conditions would make it unreasonable to do so. (4) Despite subsection (1), a licensee who provides a care program described as Occasional Child Care need not provide a program of outdoor activities. (5) Despite subsection (3), that subsection applies to a licensee who provides a care program described as Child-minding only if the program provides care for 3.5 hours or more each day.
Observation: Documentation observed which states a behaviour management technique that includes denying a child outdoor time. A discussion was had to ensure that all children have access to daily outdoor play

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: Internal incident reports reviewed. It was found, based on the details captured, that 2 incidents met the definition as described in 'schedule H' of the CCLR
Corrective Action(s): Ensure notification is provided to licensing within 24 hours when a child is involved in or may have been involved in a reportable incident.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: An audit was done on 4 children's files and 2 files were observed to not have care plans developed
Corrective Action(s): Please ensure care plans are developed in consultation with the required individuals

RECORDS AND REPORTING: 19370 - DLSOP Safe Play Space (maintenance of equipment [b3]) - [bullet 3] Keep a log of all inspections, maintenance and repairs.
Observation: The playground inspection log was observed from October 1- October 25 and it was noted that records do not show that the playground checks are being done. The licensee stated that the checks are done but not recorded
Corrective Action(s): Please ensure a system is developed that captures continued outdoor play inspections occur

Comments

This report was written off-site, however, the contraventions were reviewed with the facility manager at the conclusion of the on-site inspection. Arrangements were made to provide the full facility report to the center on October 26, 2018 at 3:00pm.
-A conversation was had about the children's safety regarding use of electric kettles
-It was noted that the dishwashing procedure included boiled water. It was discussed that the warm water from the tap would suffice and that boiled water was not a requirement
-The resource on food handling outlines the types of food preparation under the health act that require a food permit
-File review shows that reporting requirements have been reviewed with staff in the past
-Manager encouraged to contact licensing when an incident is unclear as to whether it meets the definition of 'reportable incidents' or for any other questions
