Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 4 staff records and noted: one file was missing character references, and one had reference names and phone numbers, but no system to indicate they were checked.
Corrective Action(s): Please ensure staff files contain all required documents, including character references.

POLICIES AND PROCEDURES: 13010 - CCLR s.22(1)(a) - A licensee must have all of the following: (a) emergency exits and a fire drill system approved by a local assistant within the meaning of the Fire Services Act.
Observation: Licensing observed a fire extinguisher on site, however was unable to determine when it was last serviced.
Corrective Action(s): Please ensure fire extinguishers are maintained yearly.

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: Licensing observed indoor supervision practices and noted the following:
- Staff was engaged with a group of children by the room attached to the main play area. Meanwhile, a child (unobserved by staff) in the kitchen area climbed into a low highchair.
- Children were playing in a room attached to the main play area. Staff remained in the bathroom and kichen for a period of 20 minutes and was not observed moving throughout the facility, therefore not providing adequate supervision to children in that space.
Corrective Action(s): Please ensure adequate supervision is maintained at all times.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation (CORRECTED DURING INSPECTION): Licensing observed 8 children in care. After reviewing children's files, it was noted that there were 4 children present under the age of 36 months old. This was discussed with the staff, and then communicated with the manager. The child was picked up from care while licensing was still present.
Corrective Action(s): Please ensure groups have no more children in attendance than permitted in Schedule E, and a system is in place to ensure the appropriate ages and numbers of children in care are maintained.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing reviewed 6 attendance records and noted 1 did not have time of departure.
Corrective Action(s): Please ensure daily attendance records indicate the time of arrival and departure for each child.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Licensing reviewed facility policies and procedures and noted the following were not available:
- Reportable Incidents
- Behavioural guidance
- Safe Release of children
- Emergency plans
- Medication
- Illness
- Nutrition
The staff on site was unaware of the incident reporting procedures or requirements.

Corrective Action(s): Please ensure all policies and procedures are available at the facility, communicated to staff, and implemented by employees.

Comments

At this inspection dated November 19, 2019 there were 8 children and 1 staff present. At this inspection, the above noted contraventions were identified.

Children were observed participating in indoor free play, snack time, transition to outdoors, outdoor play, lunch time and circle.

Supervision practices, policies and procedures, and reportable incidents were discussed with the staff on site and the manager. Also as discussed, ensuring any expired items in the emergency supply kit are removed and replaced.

Licensing left the facility to complete the report off site - all contraventions were reviewed with the manager prior to writing the report. Licensing returned to the facility at the agreed upon time on November 20, 2019 to deliver the report and risk assessment.
Due to the number of contraventions identified during the inspection, a written response is required by Monday, November 25, 2019. In your written response, please include: your system to ensure how appropriate ages and numbers of children in care are maintained at all times; and outline your staff orientation procedures, as it was identified that staff were not familiar with reporting requirements, policies, or licensing regulations.
As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.
