Introduction

An unscheduled inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Audit of four (4) staff files revealed one (1) Criminal Record Check is not site specific and was not obtained through the sharing process available via the CRC online system. Three (3) staff files did not contain current Criminal Record Checks or at a minimum updated checklist documenting the expiry dates.
Corrective Action(s): Please ensure all legislatively required documentation is obtained and maintained at all times

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Audit of 4 staff files revealed two missing reference check confirmations
Corrective Action(s): Please ensure all legislatively required documentation is obtained and maintained at all times

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Audit of 4 staff files revealed two files missing certification validation
Corrective Action(s): Please ensure all legislatively required documentation is obtained and maintained

Comments

At the inspection dated March 9, 2023 there were 16 children and 2 staff and 2 parent helpers present.

At this inspection the above noted contravention were identified. The Licensee/Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed. For this inspection the contents of the Facility Inspection Report and Risk Assessment were discussed and provided to the Licensee and/or Manager while on site.
