Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act(CCALA), the Child Care Licensing Regulations(CCLR) and the relevant Director of Licensing Standards of Practice(DLSOP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: There was a TV in the classroom not securely installed ( fall hazard).
Corrective Action(s): Please ensure that a healthy and safe environment is provided at all times while children are in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11220 - CCLR s.23(2) - A licensee must have first aid kits that are readily accessible to all employees, including while care is provided off the community care facility premises.
Observation: The first aid kit has insufficient supplies.
Corrective Action(s): Please replenish the first aid kit with sufficient supplies. (repeat contravention)

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Criminal Record Check not obtained for 1 staff member.
Corrective Action(s): Please ensure that all staff files are complete.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A minimum of two character references were not obtained for one or more employees.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one or more employees.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: 1 staff member's certificate was not validated through the ECE registry as required.
Corrective Action(s): Please ensure that all staff files are complete.

CARE AND/OR SUPERVISION: 14090 - CCLR s.40(2) - A licensee providing a care program described as Preschool (30 Months to School Age) must not provide care for more than 4 hours each day to each child.
Observation: The facility operates an extended preschool hours.
Corrective Action(s): Please ensure that you meet the maximum hours of care requirement.

RECORDS AND REPORTING: 19120 - CCLR s.57(2)(f) - A licensee must keep, for each child, a record showing the following information: (f) any medication administered to the child, including the amount and the time at which the medication was administered.
Observation: No record showing the amount and time that a medication was administered to a child.
Corrective Action(s): Please ensure that record of child's medication administration is kept accurately.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: 2 children's files were reviewed; 1 child's photo ( digital image) is missing.
Corrective Action(s): Please ensure that all children's files are complete.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: Care plan not developed in consultation with the parent or any person requested by the parent. (repeat contravention)
Corrective Action(s): Please ensure that all children's files are complete.

Comments

On the inspection date of January 13, 2022 there were 2 children and 2 staff present. At this inspection the above noted contraventions were identified and the Licensee is required to take corrective action to bring the facility into compliance and submit a written response by below date for Licensing to review. The contravention noted in this report was reviewed with the staff during inspection and with the Manager after the inspection via phone. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is attached.
The following were discussed with the Manager:

- Attendance records for children: to ensure that daily attendance is kept accurately including their departure/arrival time as well as their absence.
- Transition between preschool and school age: to ensure that appropriate care and supervision is provided to the children at all time and that policies & procedures are implemented by the staff during program transition times.
- Emergency supplies: to ensure that sufficient supplies are available for 72 hours ( recommended) and to make the supplies easily accessible to the staff. Some strategies were discussed today with the Manager.
