Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed in the IT nap room that the cribs were too close and touching each other and the nap room was also being used for storage. Manager stated that the toys were stored in there to be switched out.
Licensing observed that the sleeping mats for the Group Child Care was being stored in the staff's bathroom. Manager stated that a suitable location will be made available to store the nap mats.
Licensing observed that in both bathrooms in the IT and group Care Program hand towels were being used. Each child had their own but it was used throughout the day multiple times and then placed in the wash at the end of the day. Manager stated that more hand towels will be purchased so that they can be used once before being placed in the laundry.
Licensing observed that there was mold in between the window and the ledge due to moisture build-up. The window ledge is accessible to children. The Manager stated that this will be cleaned and addressed.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed 5 staff files and noted 2 had no Criminal Record Check and 1 was obtained through another organization. Manager is aware and have sent off for the appropriate CRC.
Corrective Action(s): Please ensure that the Criminal Record Checks are obtained through the Records Review Board in Victoria.

NUTRITION AND FOOD SERVICES: 17010 - CCLR s.48(1)(a) - A licensee must (a) ensure that each child has healthy food and drink according to the Canada's Food Guide.
Observation: Licensing recorded the fridge temperatures in both classroom and they were both recorded at 6.9 degrees celsius.
Corrective Action(s): Please ensure that the fridge temperature is between 0-4 degrees celsius to prevent food spoilage.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing reviewed 6 children's files and noted that 1 was missing the MSP number.
Corrective Action(s): Please ensure that children's MSP number is recorded.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Licensing reviewed 6 children's files and noted 1 was missing date of enrolment.
Corrective Action(s): Please ensure that children's date of enrolment is recorded.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: Licensing noted a care plan had not been updated since 2019.
Corrective Action(s): Please ensure care plans are reviewed at least once a year.

Comments

Summary of Inspection
At the inspection dated May 28, 2021 there were 11 children and 3 staff present in the Group Child Care under 36 months and 10 children, 2 staff and 1 practicum student in the Group Child Care 30 months to School Age. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:

Licensing discussed with the Manager to have staff remove personal belongings so that it is not accessible to children.
Licensing discussed with the Manager to remove the mop and bucket from the Infant bathroom so that it is not accessible to children.
