Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP).
All care categories were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: A certificate of one staff working on site today was not posted. Discussed with the staff on site as to the requirement.
Corrective Action(s): Please ensure all certified staff certificates are prominently posted for those currently employed at the facility.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Of four staff files reviewed, three were missing evidence of having a current clearance through the criminal record review program. Staff on site said that they have obtained a clearance through the school but there was no evidence on site.
Corrective Action(s): Please ensure clearances obtained for staff are available for review.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Copies of any diplomas, certificates or other evidence of the person's training and skills were not available for review for one of four staff files reviewed.
Corrective Action(s): Please ensure a system is in place for collecting all necessary documents for employees and recording that information.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained or available for review for one or more employees.
Corrective Action(s): Please ensure all employee information is collected/documented.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Of four staff files reviewed, one was missing validation.
Corrective Action(s): Please ensure all certified staff are validated through the ECE Registry.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Attendance records reviewed did not show arrival and departure times for children. Staff said that they had recently changed from an app system to this paper one.
Corrective Action(s): As discussed, please ensure accurate records are maintained particularly in case of an emergency situation.

RECORDS AND REPORTING: 19340 - CCLR s.59(c) - In respect of a record referred to in this Division, a licensee must (c) produce records, on demand, to the medical health officer.
Observation: Staff files reviewed had a checklist of documents required for each staff. This checklist was not complete for 3 out of the 4 staff. Staff on site couldn't produce the records required and said that it may be held at the school, but weren't sure.
Corrective Action(s): Checklists are acceptable if the information is clear that staff have been screened appropriately and records held elsewhere. Please provide a corrective action plan to Licensing with details of what records are held and where.

Comments

At today’s inspection there were 16 children and 2 staff present.
Licensing could not review the physical space for the SAoSG program as it was occupied with school students.

At this inspection the above noted contraventions were identified.
The Licensee is required to address the contraventions to bring the facility back into compliance and provide a written response to Licensing by the date below.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

The following was discussed:
- Having staff records located in one place for ease of access.
- Attendance records in emergency situations
- Outdoor play area - no changes
- Emergency evacuation plan to be followed during annual practice (secondary location)
- Minor incident reporting recommendations
- Licensing Duty line: #604 587 3936 for emergencies if area Licensing Officer can’t be contacted.

The contents of this inspection report were reviewed with the facility prior to being written off site due to technical difficulties, therefore no signatures attached. A copy was later provided.
