Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

Nutrition
Program
Child Records and reporting

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

At time of this inspection all areas inspected were found to be in compliance with the exception of those noted below:

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Three staff files were reviewed and staff documentation was complete with the exception of missing a Criminal Record Check (CRC) for one staff. There is a consent on file indicating the CRC was requested in Dec 2016. The Licensee indicated she has contacted the Criminal Record Review Agency and was advised it is in line to be processed. The Licensee stated this staff does not work alone. Another staff has a CRC from another site and Licensee has requested a site specific CRC.
Corrective Action(s): Please ensure CRC's are completed prior to employment of staff.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: At time of Licensing Officer's arrival there were 15 children in care with two staff. However, one staff's ECE Certificate expired on March 12,2018 and the other staff's ECE Assistant Certifictae was valid. Staff qualifictaion requirements were in compliance once the Manager who is qualified as an ECE arrived approximately 15 minutes later. The staff is in precess of completing courses required for renewal.

Corrective Action(s): Please ensure ratio of qualified staff is in compliance with CCLR requirements at all times or an exemption approval has been obtained for an alternative staff plan.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: All sleeping mats had the bedding sheets on them and were stacked together with sheets in contact to other mats. The blankets were also stacked in a pile.
Corrective Action(s): Please ensure children's bedding is stored individually to prevent spread of illness or disease.

Comments

At time of this inspection the following was also observed and or discussed with the Licensee/Manager and/or staff:

--Upon arrival,Licensing observed Staff assisting children to get ready to go outside with one staff taking a group of children outside while other's finished getting ready and followed shortly after. Staff locked the gate once children went outside and staff maintained appropriate supervision of children outside and came in with any child who came inside to use the washroom. Staff was observed using appropriate language and guidance techniques. Children were outside for approximately one hour and staff stated children are provided opportunity for daily outdoor play in the morning as well as afternoons. This was followed by lunch and nap time. The staff ate with the children and assisted those who required help with opening containers and encouragement to eat.
-- Children were observed washing hands after outdoor play and after use of the washroom.
--Licensee has completed the new policy for Active Play and screen use. The Licensee notified all parents of the new policies. The policy has been added to the facility policy binder.
--Discussion took place regarding process for requesting exemption for staff plan.
A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
