Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP).
All care categories were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Staff on site did not have a current criminal record chek on file. Director stated that it was applied for, but no evidence of previous clearance.
Corrective Action(s): A health and safety plan will be required for this staff to continue working alone at the facility.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: On review of the staff file for the staff on site today, no character references were available. Discussed with the Director.
Corrective Action(s): Please ensure that staff are appropriately screened and documentation obtained prior to working with the children

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for one or more employees.
Corrective Action(s): Please ensure staff files are complete prior to working with the children.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one or more employees.
Corrective Action(s): Please ensure staff files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Staff file did not have validation of certification from the ECE Registry.
Corrective Action(s): Please ensure all staff files were complete at the time of employment.

STAFFING: 12180 - CCLR s.22(2)(a) - A licensee must ensure that each employee (a) is trained in the implementation of the fire drill system and emergency plan described in subsection (1), including the use of any equipment noted in the fire drill system and emergency plan.
Observation: In discussion with the staff, orientation has not taken place to ensure a safe emergency drill, nor is the emergency policy available for staff review.
Corrective Action(s): Please ensure all staff are appropriately orientated in facility emergency procedures.

PROGRAM: 18060 - CCLR s.44(3)(4)(5) - A licensee, other than a licensee providing a care program described as Occasional Child Care, must provide each child with daily outdoor play periods unless weather conditions would make it unreasonable to do so. (4) Despite subsection (1), a licensee who provides a care program described as Occasional Child Care need not provide a program of outdoor activities. (5) Despite subsection (3), that subsection applies to a licensee who provides a care program described as Child-minding only if the program provides care for 3.5 hours or more each day.
Observation: In discussion with the staff, daily outdoor play was not provided by request of parents or due to cold weather. Discussed further with staff.
Corrective Action(s): Plese ensure all children are provided with daily outdoor play to promote healthy lifestyle

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Two children's files were missing enrolment dates

Comments

Summary of Inspection

At today’s inspection there were four children and one staff present. The Manager no longer works at the facility. Discussed further with the Director.

At this inspection the above noted contraventions were identified.
The Licensee is required to address the contraventions to bring the facility back into compliance and provide a written response to Licensing by the date below.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

The following was discussed:
- Valid CRC/s are available and reviewed expiry dates.
- Active Play promotion and outdoor play
- Hygiene and sanitization practices and communicable disease plan
- Orientation of new staff
- Audit of staff files
- Nutrition options for children
- Licensing Duty line: #604 587 3936 for emergencies if area Licensing Officer can’t be contacted.
- Regular review of BCCDC website for COVID-19 updates (see link below)
