Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: During inspection Licensing noted the water in the Preschool classroom was measured at 54.1 degrees celsius and the water in the Infant bathroom was measured at 56.1 degrees celcius.
Corrective Action(s): Please ensure that heated water accessible to children is heated to no more than 49 degrees celsius.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed 5 staff files and noted 1 had no Criminal Record Check and 2 others were obtained through another organization. Manager was aware and is in the process of obtaining the appropriate CRC.
Corrective Action(s): Please ensure that the Criminal Record Checks are obtained through the Records Review Board in Victoria.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 5 staff files and noted 1 had no references. Manager stated that the evidence of the references was stored on her phone which was later printed and placed in the staff's file at the second inspection.
Corrective Action(s): Please ensure that character references are obtained in respect to the person.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Licensing reviewed 5 staffs files and noted that 2 had no record of the person's work history.
Corrective Action(s): Please ensure to obtain records of the person's work history.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Licensing reviewed 5 staffs files and noted that 2 had no immunization records.
Corrective Action(s): Please ensure to obtain evidence of immunization.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed 5 staff files and noted 2 had no validation of certificates.
Corrective Action(s): Please ensure that a system is in place to verify staffs certificates.

CARE AND/OR SUPERVISION: 14090 - CCLR s.40(2) - A licensee providing a care program described as Preschool (30 Months to School Age) must not provide care for more than 4 hours each day to each child.
Observation: During inspection Licensing noted that care being provided to children in a Program described as Preschool (30 months to School Age) was more than 4 hours.
Corrective Action(s): Please ensure that care provided to children in a Preschool is no more than 4 hours.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: During review of 10 children's files Licensing noted that 2 children were missing immunization status.
Corrective Action(s): Please ensure to obtain evidenceof immunization.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: During review of 10 children's files Licensing noted that 2 were missing the enrolment date.
Corrective Action(s): Please ensure that the date of enrolment is recorded.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: During review of the facilities attendance records Licensing noted that numerous times of departure were not recorded.
Corrective Action(s): Please ensure that times of departure is recorded.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: During review of 10 children's files Licensing noted that 2 were missing the name and telephone number of a medical practitioner.
Corrective Action(s): Please ensure that the name and telephone number of a medical practitioner is obtained.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: During inspection Licensing noted that 3 children did not have a photo or digital image to readily identify the child.
Corrective Action(s): Please ensure that a photo or digital image is available to identify the child.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: During inspection Licensing noted that a care plan was not reviewed yearly, the last review was dated July-11-2018.
Corrective Action(s): Please ensure that care plans are reviewed at least once each year.

Comments

Summary of Inspection
At the inspection dated March 01, 2021 there were 15 children, 3 staff and 1 practicum student present. At the inspection dated March 02, 2021 there were 12 children, 3 staff and 1 practicum student present At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following education/recommendations were provided:
Playground plan and schedule as 2 programs share the play space.
Posting allergies making it accessible so staff are aware of the procedures to follow.
Filing items in a single location.
Policy for an away play space.
Immunization status required is yes /no, the whole document is not a Licensing requirement.
