Introduction

This was an unannounced follow up inspection. The purpose of this visit was to follow up the contravention items listed on the previous routine inspection report.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: Writer observed total of 11 children in care at arrival. The manager was doing head counting at the deck and getting ready for an outdoor time. They walked through the backyard of another facility and headed outside. 3 School age children were stayed behind and in care with the licensee of the other facility (who is also the owner of this facility).
The licensee explained that these 3 children were their neighbor's children and they were not expected to be in care at the facility. The licensee stated that they should be in care by an individual. Soon after this conversation, the individual returned and picked these 3 children and walked away.

Corrective Action(s): This facility has a licence of Multi Age Child Care with capacity of 8. The manager must ensure that there are maximum of 8 children at any one time and the age of the children are meeting schedule E of the Child Care Licensing Regulation.
This is a repeated contravention. Licensing observed 9 children during the last inspection. Licensing had explained that you must comply with the Regulation requirement and communicate with the facility owner if you have any concerns.

Comments

Writer continued to have the conversation with the Licensee after the children left the facility. Writer explained and discussed the importance of compliance of the Regulation and asked the licensee to rectify the concern immediately. The licensee agreed.

Writer decided to return to the facility on another day to complete the inspection due to the manager and the children were not on site.

Writer returned on July 8 2016 to complete the inspection. All other contraventions listed on the previous report appeared to addressed appropriately.

The facility program (Schedule G) will continue to be monitored.

The manager stated that they had spoken with the licensee after the routine inspection and the licensee had addressed the concerns. They also stated that all toys and equipment were now stored at the facility and have all the items they needed.

The manager has questions about children's lunch. Writer stated that all perishable foods (i.e. milk, rice, noodles, meat) must be kept in the refrigerator or in a lunch bag with a ice pack to keep them cold. Parents should be reminded and encouraged to bring healthy and varieties of food for children.

Writer reminded the manager the maximum capacity of the facility is 8 at anyone time and they must communicate with the Licensee when the facility has reached 8 children. The manager explained that she was aware of the maximum of capacity and those 3 school age children do not attend often. for example, may be once a week for a few hours in the morning time.
